H.F. 2212 Section 1. Section 299.1A, subsections 1 and 2, Code 2022, 1 are amended to read as follows: 2 1. a. Except as provided in subsections 2 and 3 , a child 3 who has reached the age of six and is under sixteen years of age 4 by September 15 is of compulsory attendance age. However, if 5 a child enrolled in a school district or accredited nonpublic 6 school reaches the age of sixteen on or after September 15, the 7 child remains of compulsory age until the end of the regular 8 school calendar. 9 b. Notwithstanding paragraph “a” , the parent or guardian of 10 a child who has reached the age of six on or after September 1, 11 but before October 1, may elect whether to have the child be 12 considered to be of compulsory attendance age for purposes of 13 this subsection by notifying the school district in writing. 14 The child of a parent or guardian who makes an election under 15 this paragraph to have the child not be considered to be of 16 compulsory attendance age under this subsection shall be 17 considered to be of compulsory attendance age under subsection 18 2. 19 2. a. A child who has reached the age of five by September 20 15 and who is enrolled in a school district shall be considered 21 to be of compulsory attendance age unless the parent or 22 guardian of the child notifies the school district in writing 23 of the parent’s or guardian’s intent to remove the child from 24 enrollment in the school district. 25 b. Notwithstanding paragraph “a” , the parent or guardian of 26 a child who has reached the age of five on or after September 27 1, but before October 1, may elect whether to have the child be 28 considered to be of compulsory attendance age for purposes of 29 this subsection by notifying the school district in writing. 30 EXPLANATION 31 The inclusion of this explanation does not constitute agreement with 32 the explanation’s substance by the members of the general assembly. 33 This bill relates to the compulsory attendance age of 34 certain specified children. 35 -1- LSB 5802YH (3) 89 jda/jh 1/ 2
H.F. 2212 The bill provides that if a child enrolled in a school 1 district or accredited nonpublic school was born in the 2 month of September, once the child reaches the age of six, 3 the child’s parent or guardian may elect for the child to be 4 considered to be five years of age for purposes of Code section 5 299.1A(2) by providing written notice to the school district. 6 The bill provides that if a child was born in the month of 7 September, once the child reaches the age of five, the child’s 8 parent or guardian may elect whether to have the child be 9 considered of compulsory attendance age for purposes of Code 10 section 299.1A(2) by providing written notice to the school 11 district. 12 -2- LSB 5802YH (3) 89 jda/jh 2/ 2
