H.F. 2202 Section 1. Section 249A.20A, subsection 11, Code 2022, is 1 amended to read as follows: 2 11. Any savings realized under this section may be used 3 to the extent necessary to pay the costs associated with 4 implementation of this section prior to reversion to the 5 medical assistance program. The department shall report the 6 amount of any savings realized and the amount of any costs paid 7 to the legislative fiscal committee on a quarterly basis. 8 Sec. 2. 2019 Iowa Acts, chapter 82, section 1, is amended 9 to read as follows: 10 SEC. 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES BRAIN 11 INJURY WAIVER MAXIMUM. The department of human services shall 12 eliminate the monthly budget maximum or cap for individuals 13 eligible for the Medicaid home and community-based services 14 brain injury waiver. The department shall track the average 15 amount expended per waiver recipient each fiscal year beginning 16 July 1, 2019, and shall report the information annually to the 17 governor and the general assembly by October 1 December 30 . 18 Sec. 3. 2020 Iowa Acts, chapter 1053, section 1, is amended 19 to read as follows: 20 SEC. 1. MEDICAID HOME AND COMMUNITY-BASED SERVICES ELDERLY 21 WAIVER MAXIMUM. The department of human services shall 22 eliminate the monthly budget maximum or cap for individuals 23 eligible for the Medicaid home and community-based services 24 elderly waiver. The department shall track the average amount 25 expended per waiver recipient each fiscal year beginning July 26 1, 2020, and shall report the information annually to the 27 governor and the general assembly by October 1 December 30 . 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill relates to reporting requirements under the 32 Medicaid program. 33 The bill eliminates the required quarterly report by the 34 department of human services (DHS) to the legislative fiscal 35 -1- LSB 5423HV (3) 89 pf/rh 1/ 2
H.F. 2202 committee of any savings realized and the amount of any costs 1 paid through the Medicaid preferred drug list program. DHS has 2 revised the process to report program performance. The annual 3 national health expenditure report released by the centers 4 for Medicare and Medicaid services which reflects the results 5 of the new process is posted, annually, on the Iowa Medicaid 6 website. 7 The bill also changes the date by which DHS is required 8 to submit an annual report to the governor and the general 9 assembly regarding the average amount expended per Medicaid 10 waiver recipient for the elderly waiver and the brain injury 11 waiver each fiscal year from October 1 to December 30. 12 -2- LSB 5423HV (3) 89 pf/rh 2/ 2
