H.F. 2154 Section 1. Section 411.5, subsection 6, paragraph b, Code 1 2022, is amended to read as follows: 2 b. (1) The system shall maintain records, including but 3 not limited to names, addresses, ages, and lengths of service, 4 salaries and wages, contributions, designated beneficiaries, 5 benefit amounts, if applicable, and other information 6 pertaining to members as necessary in the administration of 7 this chapter , as well as the names, addresses, and benefit 8 amounts of beneficiaries. For the purpose of obtaining 9 these facts, the system shall have access to the records of 10 the participating cities and the cities shall provide such 11 information upon request. Member and beneficiary records 12 containing personal information are not public records for the 13 purposes of chapter 22 . However, summary 14 (2) The following records maintained under this chapter are 15 not public records for the purposes of chapter 22: 16 (a) Records containing social security numbers. 17 (b) Records specifying amounts accumulated in members’ 18 accounts and supplemental accounts. 19 (c) Records containing names or addresses of members or 20 their beneficiaries. 21 (d) Records containing amounts of payments to members or 22 their beneficiaries. 23 (e) Records containing financial or commercial information 24 that relates to the investment of retirement system funds if 25 the disclosure of such information could result in a loss to 26 the retirement system or to the provider of the information. 27 (3) Summary information concerning the demographics of 28 the members and general statistical information concerning 29 the system is subject to chapter 22 , as well as aggregate 30 information by category. 31 EXPLANATION 32 The inclusion of this explanation does not constitute agreement with 33 the explanation’s substance by the members of the general assembly. 34 This bill concerns what member records of the statewide fire 35 -1- LSB 5496HV (1) 89 ec/rn 1/ 2
H.F. 2154 and police retirement system established by Code chapter 411 1 are public records for purposes of Code chapter 22 governing 2 open records. 3 The bill strikes language for the pension system that 4 pension system member and beneficiary records containing 5 personal information are not public records.
