H.F. 2148 Section 1. Section 279.13, subsection 2, Code 2022, is 1 amended to read as follows: 2 2. a. The contract shall remain in force and effect for 3 the period stated in the contract and shall be automatically 4 continued for equivalent periods except as modified or 5 terminated by mutual agreement of the board of directors and 6 the teacher or as modified or terminated in accordance with 7 the provisions specified in this chapter . A contract shall 8 not be offered by the employing board to a teacher under its 9 jurisdiction prior to March 15 of any year. 10 b. A teacher who has not accepted a contract for the 11 ensuing school year tendered by the employing board may resign 12 effective at the end of the current school year by filing a 13 written resignation with the secretary of the board. The 14 resignation must be filed not later than the last day of the 15 current school year or the date specified by the employing 16 board for return of the contract, whichever date occurs first. 17 However, The teacher shall file the written resignation on or 18 before the later of the following, provided that a teacher 19 shall not be required to return a contract to the board or to 20 resign less than twenty-one days after the contract has been 21 offered : 22 (1) The date specified by the employing board . 23 (2) June 30 of the current school year. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill relates to a teacher’s filing of a written 28 resignation with the board of directors of a school district. 29 Under current law, a teacher who has not accepted a contract 30 for the ensuing school year may resign effective at the end of 31 the current school year by filing a written resignation with 32 the secretary of the employing board not later than the last 33 day of the current school year or the date specified by the 34 employing board, whichever date occurs first. H.F. 2148 also provides that a teacher shall not be required to return a 1 contract to the employing board or to resign less than 21 days 2 after the contract has been offered. 3 The bill requires that the teacher file the written 4 resignation on or before the date specified by the employing 5 board or June 30 of the current school year, provided that 6 a teacher shall not be required to return a contract to the 7 employing board or to resign less than 21 days after the 8 contract has been offered. 9 -2- LSB 5268HV (2) 89 jda/jh 2/ 2
