SECTION
.
146E.1
Dispensing
of
1
abortion-inducing
drugs
——
penalty.

1.
A
person
shall
not
dispense
an
abortion-inducing
drug
3
to
a
patient
in
this
state
for
use
by
such
patient
in
inducing
4
a
medication
abortion
unless
the
abortion-inducing
drug
is
5
dispensed
directly
to
such
patient
in
a
health
care
setting.

2.
A
person
who
intentionally,
knowingly,
or
recklessly
7
violates
this
section
is
guilty
of
a
serious
misdemeanor.

3.
For
the
purposes
of
this
section:
9
a.
“Abortion”
means
the
termination
of
a
human
pregnancy
10
with
the
intent
other
than
to
produce
a
live
birth
or
to
remove
11
a
dead
fetus.
12
b.
“Abortion-inducing
drug”
means
a
drug,
medicine,
mixture,
13
or
preparation
when
prescribed
or
administered
with
the
intent
14
to
terminate
the
pregnancy
of
a
woman
known
to
be
pregnant.
15
“Abortion-inducing
drug”
includes
mifepristone
and
misoprostol.
16
c.
“Dispense”
means
relative
to
an
abortion-inducing
drug,
17
to
deliver
the
abortion-inducing
drug
to
the
ultimate
user.
18
d.
“Health
care
setting”
means
a
clinic,
medical
office,
or
19
hospital.
20
e.
“Medication
abortion”
means
an
abortion
performed
by
the
21
administration
or
use
of
an
abortion-inducing
drug.

EXPLANATION
23
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
24
the
explanation’s
substance
by
the
members
of
the
general
assembly.
25
This
bill
prohibits
a
person
from
dispensing
an
26
abortion-inducing
drug
to
a
patient
in
this
state
for
use
by
27
such
patient
in
inducing
a
medication
abortion
unless
the
28
abortion-inducing
drug
is
dispensed
directly
to
such
patient
in
29
a
health
care
setting.
30
A
person
who
intentionally,
knowingly,
or
recklessly
31
violates
the
bill
is
guilty
of
a
serious
misdemeanor.
A
32
serious
misdemeanor
is
punishable
by
confinement
for
no
more
33
than
one
year
and
a
fine
of
at
least
$430
but
not
more
than
34
$2,560.
