H.F. 2115 Section 1. Section 321.40, Code 2022, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 11. A form for verification that financial 3 liability coverage is in effect for a motor vehicle pursuant 4 to section 321.20B shall accompany each renewal statement sent 5 to the owner of the motor vehicle under this section. The 6 county treasurer shall refuse to renew the registration of a 7 motor vehicle if the applicant does not submit the completed 8 form accompanied by satisfactory proof that financial liability 9 coverage is in effect for the motor vehicle pursuant to section 10 321.20B. This subsection does not apply to a motor vehicle 11 excluded from the requirements of section 321.20B. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill requires the owner of a motor vehicle to verify 16 that financial liability coverage is in effect for the vehicle 17 as required under Code section 321.20B each time the vehicle 18 registration is renewed. When applying to renew the vehicle 19 registration, the owner is required to complete and submit 20 a verification form provided by the county treasurer along 21 with proof that financial liability coverage is in effect 22 for the vehicle. The county treasurer is prohibited from 23 renewing a registration in the absence of the completed form 24 and satisfactory proof that financial liability coverage is in 25 effect for the vehicle. 26 The bill does not apply to motor vehicles excluded from the 27 requirements of Code section 321.20B. 28 -1- LSB 5421YH (3) 89 th/ns 1/ 1
