H.F. 209 Section 1. Section 321.113, subsections 2 and 3, Code 2021, 1 are amended to read as follows: 2 2. If a motor vehicle is more than seven five model years 3 old, the part of the annual registration fee that is based 4 on the value of the vehicle shall be seventy-five percent of 5 the rate as fixed when the motor vehicle was new and the total 6 fee shall not be less than fifty dollars; except that if the 7 registration is a renewal for a vehicle registered to the 8 same owner prior to January 1, 2009, the annual registration 9 fee shall not be more than the fee paid for the previous 10 registration year. 11 3. If a motor vehicle is more than nine six model years 12 old, the part of the annual registration fee that is based on 13 the value of the vehicle shall be fifty percent of the rate as 14 fixed when the motor vehicle was new and the total fee shall 15 not be less than fifty dollars; except that if the registration 16 is a renewal for a vehicle registered to the same owner prior 17 to January 1, 2009, the annual registration fee shall not be 18 more than the fee paid for the previous registration year. 19 Sec. 2. Section 321.113, subsection 4, paragraphs a and b, 20 Code 2021, are amended to read as follows: 21 a. Except as provided in paragraph “b” , if a motor 22 vehicle is twelve nine model years old or older, the annual 23 registration fee is fifty thirty-five dollars; except that if 24 the registration is a renewal for a vehicle registered to the 25 same owner prior to January 1, 2009, the annual registration 26 fee shall not be more than the fee paid for the previous 27 registration year. 28 b. If the registration is a renewal for a motor vehicle 29 registered as an antique vehicle by the same owner prior 30 to January 1, 2009, the annual registration fee shall be 31 twenty-seven dollars for a motor vehicle that is model year 32 1990 through 1993, twenty-three dollars for a motor vehicle 33 that is model year 1970 through 1983 1989, and sixteen dollars 34 for a motor vehicle that is model year 1969 or older. 35 -1- LSB 1722YH (2) 89 th/ns 1/ 2
H.F. 209 Sec. 3. EFFECTIVE DATE. This Act takes effect January 1, 1 2022. 2 EXPLANATION 3 The inclusion of this explanation does not constitute agreement with 4 the explanation’s substance by the members of the general assembly. 5 In 2008, the general assembly amended the motor vehicle 6 registration laws for purposes of increasing revenue to the 7 transportation investment moves the economy in the 21st century 8 fund, commonly referred to as the TIME-21 fund. This bill 9 reverts portions of certain provisions relating to automatic 10 reduction of motor vehicle registration fees back to the model 11 year age thresholds and amounts that were in place before 12 January 1, 2009. 13 The bill applies the automatic reduction of 25 percent 14 to registration fees for motor vehicles more than five model 15 years old. The bill applies the automatic reduction of 50 16 percent to registration fees for motor vehicles more than six 17 model years old. The bill does not strike the $50 minimum for 18 such registration fees, which was enacted as part of the 2008 19 changes. 20 The bill makes the annual registration fee for motor 21 vehicles nine model years old or older $35, unless the vehicle 22 is registered by the same owner as it was prior to January 23 1, 2009, pursuant to current law. If the motor vehicle is 24 registered as an antique vehicle by the same owner as it was 25 prior to January 1, 2009, the annual registration fee is $27 26 for a motor vehicle that is model year 1990 through 1993, $23 27 for a motor vehicle that is model year 1970 through 1989, and 28 $16 for a motor vehicle that is model year 1969 or older. 29 The bill takes effect January 1, 2022. 30 -2- LSB 1722YH (2) 89 th/ns 2/ 2
