H.F. 2074 Section 1. Section 600.8, Code 2022, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 7A. Any investigation or report required 3 under this section shall not apply when all of the following 4 criteria are met: 5 a. The person to be adopted is a minor. 6 b. The adoption petitioner was appointed guardian of the 7 minor pursuant to chapter 232D at least three years prior to 8 the filing of the adoption petition. 9 c. The adoption petitioner has undergone the background 10 checks required pursuant to section 232D.307. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill provides that preplacement and postplacement 15 investigations and reports generally required as part of the 16 adoption process do not apply when the person to be adopted is 17 a minor, the adoption petitioner was appointed guardian of the 18 minor at least three years prior to the filing of the adoption 19 petition, and the adoption petitioner has undergone criminal 20 record checks and checks of the child abuse, dependent adult 21 abuse, and sex offender registries in the state as required for 22 all minor guardianships. 23 -1- LSB 5550YH (4) 89 pf/rh 1/ 1
