H.F. 2067 Section 1. NEW SECTION . 94.1 Definitions. 1 As used in this chapter, unless the context otherwise 2 requires: 3 1. “Applicant” means a natural person who applies to be an 4 employee. 5 2. “Employee” means a natural person who is employed in this 6 state for wages by an employer. 7 3. “Employer” means a person, as defined in chapter 4, who 8 in this state employs for wages natural persons. 9 Sec. 2. NEW SECTION . 94.2 Required vaccine —— limitations. 10 Notwithstanding any other law to the contrary, an employer 11 as a condition of employment shall not require an applicant or 12 employee to receive a vaccine for which a biologics license 13 application has not been approved pursuant to 42 U.S.C. §262 by 14 the United States food and drug administration. 15 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 16 importance, takes effect upon enactment. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill prohibits an employer from requiring an applicant 21 or employee to receive a vaccine for which a biologics license 22 application has not been approved by the United States food and 23 drug administration pursuant to federal law. 24 The bill takes effect upon enactment. 25 -1- LSB 5022YH (2) 89 pf/rh 1/ 1
