H.F. 2053 Section 1. NEW SECTION . 279.76 Nonpartisan education. 1 1. A teacher of social studies, civics, United States 2 government, United States history, or any similar course, 3 shall not be compelled by a policy of any state agency, school 4 district, or school administration to discuss current events 5 or widely debated and currently controversial issues of public 6 policy or social affairs. 7 2. A teacher who chooses to discuss current events or widely 8 debated and currently controversial issues of public policy or 9 social affairs shall, to the best of the teacher’s ability, 10 explore such issues or affairs from diverse and disparate 11 perspectives. 12 3. In any course on social studies, civics, United States 13 government, United States history, or any similar course, a 14 school district shall not require, make part of such course, 15 or award course grading or credit to, student work for, 16 affiliation with, or service learning in association with, 17 any organization engaged in lobbying for legislation at the 18 local, state, or federal level, or in social or public policy 19 advocacy. 20 4. In any course on social studies, civics, United States 21 government, United States history, or any similar course, a 22 school district shall not require, make part of such course, or 23 award course grading or credit to, lobbying for legislation at 24 the local, state, or federal level, or any practicum, or like 25 activity, involving social or public policy advocacy. 26 5. A school district shall not accept any moneys from a 27 private person or private source pertaining to instruction in 28 social studies, civics, United States government, United States 29 history, or any similar class, for curriculum development, the 30 purchase of materials for use in the curriculum, training, or 31 professional development. 32 6. A teacher shall not be compelled by a policy of any state 33 agency, school district, or school administration to affirm 34 a belief in the so-called systemic nature of racism, or like 35 -1- LSB 5234YH (1) 89 jda/jh 1/ 3
H.F. 2053 ideas, or in the so-called multiplicity or fluidity of gender 1 identities, or like ideas, against the teacher’s sincerely held 2 religious or philosophical convictions. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill relates to the curriculum provided by school 7 districts. 8 The bill provides that a teacher of social studies, civics, 9 United States government, United States history, or any similar 10 course, shall not be compelled to discuss current events or 11 widely debated and currently controversial issues of public 12 policy or social affairs. If a teacher does choose to discuss 13 such issues or affairs, the bill requires the teacher to 14 explore such issues or affairs from diverse and disparate 15 perspectives. 16 The bill provides that in any course on social studies, 17 civics, United States government, United States history, or any 18 similar course, a school district shall not make part of such 19 course student affiliation with any organization engaged in 20 lobbying for legislation at the local, state, or federal level, 21 or in social or public policy advocacy. 22 The bill provides that in any course on social studies, 23 civics, United States government, United States history, or any 24 similar course, a school district shall not make part of such 25 course lobbying for legislation at the local, state, or federal 26 level, or any like activity involving social or public policy 27 advocacy. 28 The bill prohibits a school district from accepting any 29 moneys from a private person or private source pertaining 30 to instruction in social studies, civics, United States 31 government, United States history, or any similar course, for 32 curriculum development, the purchase of materials for use in 33 the curriculum, training, or professional development. 34 The bill provides that a teacher shall not be compelled to 35 -2- LSB 5234YH (1) 89 jda/jh 2/ 3
