1.
NEW
SECTION
.
94.3
COVID-19
testing
requirements
1
by
employers.

1.
An
employer
that
requires
an
employee
to
undergo
routine
3
COVID-19
testing
as
an
alternative
to
receiving
a
COVID-19
4
vaccine
shall
do
all
of
the
following:
5
a.
Pay
all
required
COVID-19
testing
expenses
on
behalf
of
6
the
employee.

b.
If
required
COVID-19
testing
is
not
conducted
on
the
8
premises
of
the
employer,
compensate
the
employee
for
all
time
9
away
from
work
necessary
to
undergo
the
required
COVID-19
10
testing.

2.
An
employer
shall
not
require
an
employee
to
undergo
12
required
COVID-19
testing
outside
of
the
employee’s
normal
13
scheduled
work
hours.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
15
importance,
takes
effect
upon
enactment.

EXPLANATION
17
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
an
employer
that
requires
an
20
employee
to
undergo
routine
COVID-19
testing
as
an
alternative
21
to
receiving
a
vaccine
shall
pay
all
costs
of
the
testing
and
22
shall
compensate
the
employee
for
all
time
away
from
work
to
23
undergo
testing
that
is
not
conducted
on
the
premises
of
the
24
employer.
The
bill
provides
that
an
employer
shall
not
require
25
an
employee
to
undergo
testing
outside
of
the
employee’s
normal
26
working
hours.
The
bill
takes
effect
upon
enactment.
