NEW SECTION . 686E.1 Definitions. 1 As used in this chapter, unless the context otherwise 2 requires: 3 1. “COVID-19” means the same as defined in section 686D.2. 4 2. “Entity” includes the state or any agency or official 5 thereof, a political subdivision or any agency or official 6 thereof, an employer, a business, or any other public or 7 private entity in this state. 8 Sec. 2. NEW SECTION . 686E.2 COVID-19 vaccination 9 requirements —— exceptions. 10 Notwithstanding any provision of law to the contrary, an 11 entity that requires the receipt of a COVID-19 vaccination by 12 any individual, including an employee or a consumer, shall 13 accept, in lieu of proof of vaccination, proof of immunity for 14 the virus that causes COVID-19 as evidenced by a confirmed 15 positive COVID-19 test or a blood test confirming the presence 16 of COVID-19 antibodies submitted as proof within three months 17 of the date of the positive COVID-19 test or blood test. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill provides that an entity that requires the receipt 22 of a COVID-19 vaccination by any individual, including an 23 employee or a consumer, shall accept, in lieu of proof of 24 vaccination, proof of immunity for the virus that causes 25 COVID-19 as evidenced by a confirmed positive COVID-19 test or 26 a blood test confirming the presence of COVID-19 antibodies 27 submitted as proof within three months of the date of the 28 positive COVID-19 test or blood test. 29 -1- LSB 5338YH (5) 89 pf/rh 1/ 1
