Section
1.
Section
42.3,
subsections
2
and
3,
Code
2022,
are
1
amended
to
read
as
follows:

2.
If
the
bill
embodying
the
plan
submitted
by
the
3
legislative
services
agency
under
subsection
1
fails
to
be
4
enacted,
the
legislative
services
agency
shall
prepare
a
bill
5
embodying
a
second
plan
of
legislative
and
congressional
6
districting.
The
bill
shall
be
prepared
in
accordance
with
7
section
42.4
,
and,
insofar
as
it
is
possible
to
do
so
within
8
the
requirements
of
section
42.4
,
with
the
reasons
cited
by
9
the
senate
or
house
of
representatives
by
resolution,
or
the
10
governor
by
veto
message,
for
the
failure
to
approve
the
plan.
11
If
a
second
plan
is
required
under
this
subsection
,
the
bill
12
embodying
it
shall
be
delivered
to
the
secretary
of
the
senate
13
and
the
chief
clerk
of
the
house
of
representatives
not
later
14
than
thirty-five
twenty-one
days
after
the
date
of
the
vote
15
by
which
the
senate
or
the
house
of
representatives
fails
to
16
approve
the
bill
submitted
under
subsection
1
,
or
the
date
17
the
governor
vetoes
or
fails
to
approve
the
bill.
If
it
is
18
necessary
to
submit
a
bill
under
this
subsection
,
the
bill
19
shall
be
brought
to
a
vote
not
less
than
seven
days
after
the
20
bill
is
submitted
and
made
available
to
the
members
of
the
21
general
assembly,
under
a
procedure
or
rule
permitting
no
22
amendments
except
those
of
a
purely
corrective
nature.
It
23
is
further
the
intent
of
this
chapter
that
if
the
bill
is
24
approved
by
the
first
house
in
which
it
is
considered,
it
25
shall
expeditiously
be
brought
to
a
vote
in
the
second
house
26
under
a
similar
procedure
or
rule.
If
the
bill
embodying
the
27
plan
submitted
by
the
legislative
services
agency
under
this
28
subsection
fails
to
be
approved
by
a
constitutional
majority
29
in
either
the
senate
or
the
house
of
representatives,
the
30
secretary
of
the
senate
or
the
chief
clerk
of
the
house,
as
the
31
case
may
be,
shall
transmit
to
the
legislative
services
agency
32
in
the
same
manner
as
described
in
subsection
1
,
information
33
which
the
senate
or
house
may
direct
by
resolution
regarding
34
reasons
why
the
plan
was
not
approved.

If
the
bill
embodying
the
plan
submitted
by
the

legislative
services
agency
under
subsection
2
fails
to
be
2
enacted,
the
same
procedure
as
prescribed
by
subsection
2
3
shall
be
followed.
If
a
third
plan
is
required
under
this
4
subsection
,
the
bill
embodying
it
shall
be
delivered
to
the
5
secretary
of
the
senate
and
the
chief
clerk
of
the
house
of
6
representatives
not
later
than
thirty-five
twenty-one
days
7
after
the
date
of
the
vote
by
which
the
senate
or
the
house
8
of
representatives
fails
to
approve
the
bill
submitted
under
9
subsection
2
,
or
the
date
the
governor
vetoes
or
fails
to
10
approve
the
bill.
The
legislative
services
agency
shall
11
submit
a
bill
under
this
subsection
sufficiently
in
advance
of
12
September
1
of
the
year
ending
in
one
to
permit
the
general
13
assembly
to
consider
the
plan
prior
to
that
date.
If
it
is
14
necessary
to
submit
a
bill
under
this
subsection
,
the
bill
15
shall
be
brought
to
a
vote
within
the
same
time
period
after
16
its
delivery
to
the
secretary
of
the
senate
and
the
chief
clerk
17
of
the
house
of
representatives
as
is
prescribed
for
the
bill
18
submitted
under
subsection
2
,
but
shall
be
subject
to
amendment
19
in
the
same
manner
as
other
bills.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.
23
This
bill
concerns
the
timetable
for
preparing
a
second
or
24
third
plan
of
legislative
and
congressional
redistricting
by
25
the
legislative
services
agency
following
rejection
of
the
26
prior
plan.
The
bill
provides
that
a
bill
embodying
a
second
27
or
third
plan
of
legislative
and
congressional
redistricting
28
shall
be
submitted
to
the
general
assembly
no
less
than
21
29
days,
instead
of
the
current
35
days,
after
the
previous
plan
30
of
legislative
and
congressional
redistricting
fails
to
be
31
approved.
