H.F. 2009 Section 1. Section 298.4, subsection 1, Code 2022, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . g. To pay the costs of employing a school 3 resource officer. For purposes of this paragraph, “school 4 resource officer” means the same as defined in 34 U.S.C. §10389. 5 Sec. 2. APPLICABILITY. This Act applies to school budget 6 years beginning on or after July 1, 2023. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill authorizes the use of revenues from the district 11 management levy for the employment of school resource officers. 12 Under current law, the board of directors of a school district 13 may certify for levy a tax on all taxable property in the 14 school district for a district management levy. The bill 15 authorizes revenues from the district management levy to be 16 expended to pay the costs of employing a school resource 17 officer. The bill defines “school resource officer” to mean a 18 career law enforcement officer, with sworn authority, deployed 19 in community-oriented policing, and assigned by the employing 20 police department or agency to work in collaboration with 21 schools and community-based organizations to address crime 22 and disorder problems, gangs, and drug activities affecting 23 or occurring in or around an elementary or secondary school; 24 to develop or expand crime prevention efforts for students; 25 to educate likely school-age victims in crime prevention and 26 safety; to develop or expand community justice initiatives for 27 students; to train students in conflict resolution, restorative 28 justice, and crime awareness; to assist in the identification 29 of physical changes in the environment that may reduce crime in 30 or around the school; and to assist in developing school policy 31 that addresses crime and to recommend procedural changes. 32 The bill applies to school budget years beginning on or after 33 July 1, 2023. 34 -1- LSB 5438YH (3) 89 jda/jh 1/ 1
