H.F. 198 Section 1. Section 708.1, subsection 2, Code 2021, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . d. (1) Intentionally points a laser 3 emitting a visible light beam at another person with the intent 4 to cause pain or injury to another. For purposes of this 5 paragraph, “laser” means a device that emits a visible light 6 beam amplified by the stimulated emission of radiation and any 7 light which simulates the appearance of a laser. 8 (2) This paragraph does not apply to any of the following: 9 (a) A law enforcement officer who uses a laser in 10 discharging or attempting to discharge the officer’s official 11 duties. 12 (b) A health care professional who uses a laser in providing 13 services within the scope of practice of that professional or 14 any other person who is licensed or authorized by law to use a 15 laser or who uses a laser in the performance of the person’s 16 official duties. 17 (c) A person who uses a laser to play laser tag, paintball, 18 and other similar games using light-emitting diode technology. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to assault involving a laser emitting a 23 visible light beam. 24 The bill adds intentionally pointing a laser emitting 25 a visible light beam at another person with the intent to 26 cause pain or injury to another to the definition of assault 27 in Code section 708.1. This definition does not apply to 28 a law enforcement officer who uses a laser in discharging 29 or attempting to discharge the officer’s official duties, 30 to a health care professional who uses a laser in providing 31 services, or to any other person who is licensed or authorized 32 by law to use a laser or uses it in the performance of 33 the person’s official duties, or to a person who uses a 34 laser to play tag, paintball, and other similar games using 35 -1- LSB 1917HV (1) 89 as/rh 1/ 2
