H.F. 114 Section 1. Section 256.7, subsection 29, Code 2021, is 1 amended by striking the subsection. 2 Sec. 2. Section 256.9, subsection 34, Code 2021, is amended 3 to read as follows: 4 34. Provide educational resources and technical assistance 5 to schools relating to the implementation of the nutritional 6 guidelines for food and beverages sold on public school grounds 7 or on the grounds of nonpublic schools receiving funds under 8 section 283A.10 . 9 Sec. 3. Section 256.9, subsections 50 and 51, Code 2021, are 10 amended by striking the subsections. 11 Sec. 4. Section 283A.1, subsection 1, Code 2021, is amended 12 to read as follows: 13 1. “Nutritionally adequate meal” means a lunch or breakfast 14 which meets the nutrition guidelines established and standards 15 promulgated by the United States department of education 16 agriculture pursuant to 7 C.F.R. pt. 210 and 7 C.F.R. §220.23 . 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill strikes provisions directing the state board 21 of education to adopt rules relating to the definition of 22 “nutritionally adequate meal”, used by school districts 23 and accredited nonpublic schools to provide meals that 24 meet federally funded school meal program requirements, and 25 requiring the state board to adopt rules establishing nutrition 26 content standards for foods and beverages sold or provided on 27 the school grounds during the school day, but exclusive of 28 foods sold for fundraising purposes and foods and beverages 29 sold at concession stands. 30 Under the bill, “nutritionally adequate meal” means a lunch 31 or breakfast which meets nutrition guidelines and standards 32 promulgated by the United States Department of Agriculture. 33 The bill eliminates a provision requiring the director 34 of the department of education to convene, in collaboration 35 -1- LSB 1551YH (3) 89 kh/jh 1/ 2
H.F. 114 with the department of public health, a nutrition advisory 1 panel to review research in pediatric nutrition. Currently, 2 the panel must meet every five years and submit its findings 3 and recommendations in a report to the state board, which the 4 state board must consider when establishing or amending rules 5 relating to the nutritional content standards. Membership 6 on the advisory panel includes at least one Iowa state 7 university extension nutrition and health field specialist 8 and representatives from the Iowa academy of nutrition and 9 dietetics, the school nutrition association of Iowa, the Iowa 10 association of school boards, the school administrators of 11 Iowa, the Iowa chapter of the American academy of pediatrics, 12 a school association representing parents, the Iowa grocery 13 industry association, an accredited nonpublic school, and the 14 Iowa state education association. 15 The bill also eliminates the requirement that the director 16 of the department of education monitor school districts 17 and accredited nonpublic schools for compliance with the 18 nutritional content standards, and a requirement that school 19 districts and accredited nonpublic schools annually make 20 the standards available to students, parents, and the local 21 community. Currently, a noncompliant school district or 22 accredited nonpublic school must submit to the director a 23 corrective action plan that sets forth the steps to be taken to 24 ensure full compliance. 25 The bill makes corresponding changes. 26 -2- LSB 1551YH (3) 89 kh/jh 2/ 2
