H.F. 103 Section 1. NEW SECTION . 280.31 Instruction delivery method 1 determined by parent or guardian. 2 If a school district or accredited nonpublic school delivers 3 coursework pursuant to section 256.11 using both in-person 4 instruction and instruction using an online learning platform, 5 the parent or guardian of the student receiving the instruction 6 may submit a written notification to the school district or 7 accredited nonpublic school specifying which instruction 8 delivery method the school district or accredited nonpublic 9 school shall use to provide the coursework to the student. 10 This section does not apply to a school district that provides 11 educational instruction and course content primarily over the 12 internet in accordance with section 256.7, subsection 32, 13 paragraph “c” , Code 2016. 14 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 15 importance, takes effect upon enactment. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill establishes that if a school district or 20 accredited nonpublic school delivers coursework required 21 under the state’s educational standards using both in-person 22 instruction and instruction using an online learning platform, 23 the parent or guardian of the student receiving the instruction 24 may submit a written notification to the school district or 25 accredited nonpublic school specifying which instruction 26 delivery method the school district or accredited nonpublic 27 school shall use to provide the coursework to the student. The 28 provision does not apply to the CAM or Clayton Ridge community 29 school districts, which provide educational instruction and 30 course content primarily over the internet. 31 The bill takes effect upon enactment. 32 -1- LSB 1913YH (4) 89 kh/jh 1/ 1
