Section 147.1, subsection 6, Code 2020, is 1 amended to read as follows: 2 6. “Profession” means medicine and surgery, podiatry, 3 osteopathic medicine and surgery, genetic counseling, practice 4 as a physician assistant, psychology, chiropractic, nursing, 5 dentistry, dental hygiene, dental assisting, optometry, speech 6 pathology, audiology, pharmacy, physical therapy, physical 7 therapist assisting, occupational therapy, occupational therapy 8 assisting, respiratory care, cosmetology arts and sciences, 9 barbering, mortuary science, applied behavior analysis, marital 10 and family therapy, mental health counseling, polysomnography, 11 social work, dietetics, massage therapy, athletic training, 12 acupuncture, nursing home administration, practice as a hearing 13 aid specialist, sign language interpreting or transliterating, 14 orthotics, prosthetics, or pedorthics. 15 Sec. 2. Section 147.2, subsection 1, Code 2020, is amended 16 to read as follows: 17 1. A person shall not engage in the practice of medicine 18 and surgery, podiatry, osteopathic medicine and surgery, 19 genetic counseling, psychology, chiropractic, physical 20 therapy, physical therapist assisting, nursing, dentistry, 21 dental hygiene, dental assisting, optometry, speech pathology, 22 audiology, occupational therapy, occupational therapy 23 assisting, orthotics, prosthetics, pedorthics, respiratory 24 care, pharmacy, cosmetology arts and sciences, barbering, 25 social work, dietetics, applied behavior analysis, marital 26 and family therapy or mental health counseling, massage 27 therapy, mortuary science, polysomnography, athletic training, 28 acupuncture, nursing home administration, or sign language 29 interpreting or transliterating, or shall not practice as a 30 physician assistant or a hearing aid specialist, unless the 31 person has obtained a license for that purpose from the board 32 for the profession. 33 Sec. 3. S.F. _____ Sec. 4. Section 147.14, subsection 1, paragraph k, Code 1 2020, is amended by striking the paragraph. 2 Sec. 5. Section 714H.4, subsection 1, paragraph a, 3 subparagraph (4), Code 2020, is amended to read as follows: 4 (4) Persons or facilities licensed, certified, or 5 registered under chapters 135B , 135C , 135J , 148 , 148A , 148B , 6 148C , 149 , 151 , 152 , 152A , 152B , 153 , 154 , 154B , 154C , 154D , 7 155A , 156 , 169 , 522B , 542 , 542B , 543B , 544A , or 544B . 8 Sec. 6. REPEAL. Chapter 152A, Code 2020, is repealed. 9 Sec. 7. TRANSITION PROVISIONS. 10 1. All moneys in a dedicated fund of the board of dietetics 11 shall be transferred to the general fund of the state on the 12 effective date of this Act. 13 2. The property and records in the custody of the board 14 of dietetics shall be transferred to the department of 15 administrative services on the effective date of this Act. 16 3. Any cause or action, claim, or obligation against the 17 board of dietetics in existence on the effective date of this 18 Act shall not be affected as a result of this Act. 19 4. An administrative hearing or court proceeding arising 20 out of an enforcement action under chapter 152A or related 21 administrative rules pending on the effective date of this 22 Act shall not be affected by this Act. Any cause of action 23 or statute of limitation relating to an action taken by the 24 board of dietetics shall not be affected by this Act and such 25 cause of action or statute of limitation shall apply to the 26 department of public health. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill repeals Code chapter 152A, imposing licensing 31 requirements on persons applying to practice dietetics in Iowa. 32 The bill also repeals the Code section creating the board of 33 dietetics and removes references to the board of dietetics. 34 The bill includes transition provisions for the disposition of 35 -2- LSB 5757XC (1) 88 ss/rh 2/ 3
