Section 96.7, subsection 8, paragraph b, 1 subparagraph (4), Code 2020, is amended to read as follows: 2 (4) The amount due specified in a bill from the department 3 is conclusive unless, not later than fifteen days following 4 the date the bill was mailed or otherwise delivered to 5 the last known address of the nonprofit organization, the 6 nonprofit organization files an application for redetermination 7 with the department setting forth the grounds for the 8 application. The department shall promptly review the amount 9 due specified in the bill and shall issue a redetermination. 10 The redetermination is conclusive on the nonprofit organization 11 unless, not later than within thirty days after the 12 redetermination was mailed or otherwise delivered to the 13 last known address of the nonprofit organization, mailing of 14 the notification, the nonprofit organization files an appeal 15 appeals to the district court pursuant department for a hearing 16 to subsection 5 determine the eligibility of the individual 17 to receive benefits . The appeal shall be referred to an 18 administrative law judge for hearing, and the employer and the 19 individual shall receive notice of the time and place of the 20 hearing. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill provides that an appeal by a nonprofit 25 organization of a redetermination by the department of 26 workforce development of the amount due for reimbursement of 27 the cost of unemployment benefits, for nonprofit organizations 28 that have elected to pay such costs by reimbursement, shall be 29 referred to an administrative law judge for hearing.
