Unless otherwise authorized or required by state or 5 federal law, data collected under this section shall not 6 include the social security number or name of the individual 7 subject of the data. 8 DIVISION II 9 EMERGENCY MEDICAL SERVICES —— PATIENT MEDICAL INFORMATION 10 Sec. 2. NEW SECTION . 147A.4A Patient medical information 11 —— limitations. 12 1. Unless otherwise authorized or required by state or 13 federal law, data collected under this subchapter, including 14 patient care reports, that contain a patient’s medical 15 information, shall not include the social security number or 16 name of the patient who is the subject of the data. 17 2. For the purposes of this section: 18 a. “Patient care report” means a computerized or written 19 report that documents the assessment and management of a 20 patient by an emergency care provider in an out-of-hospital 21 setting. 22 b. “Patient’s medical information” means any information in 23 an emergency medical services ambulance or transport document 24 or report, including a patient care report, that identifies a 25 patient who is the subject of the information or with respect 26 to which there is a reasonable basis to believe that the 27 information could be used to identify the patient. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill relates to the protection of certain patient 32 health data and information under the purview of the department 33 of public health (DPH). 34 HOSPITAL DATA. S.F. _____ regard to certain inpatient, outpatient, and ambulatory data 1 collected from hospitals, unless otherwise authorized or 2 required by state or federal law, in addition to the social 3 security number, the name of the individual subject of the data 4 shall not be included in data collected from hospitals by DPH. 5 EMERGENCY MEDICAL SERVICES. Division II of the bill 6 provides that, unless otherwise authorized or required by 7 state or federal law, data collected under Code chapter 147A, 8 subchapter I (emergency medical care), including patient care 9 reports, that contain a patient’s medical information, shall 10 not include the social security number or name of the patient 11 who is the subject of the data. 12 The division defines “patient care report” as a computerized 13 or written report that documents the assessment and 14 management of a patient by an emergency care provider in an 15 out-of-hospital setting; and “patient’s medical information” as 16 any information in an emergency medical services ambulance or 17 transport document or report, including a patient care report, 18 that identifies a patient who is the subject of the information 19 or with respect to which there is a reasonable basis to believe 20 that the information could be used to identify the patient. 21 -2- LSB 2751XC (6) 88 pf/rh 2/ 2
