S.F. _____ H.F. _____ Section 1. Section 8.57F, subsection 2, paragraph a, Code 1 2019, is amended by striking the paragraph. 2 Sec. 2. Section 12.30, subsection 1, paragraph a, Code 2019, 3 is amended to read as follows: 4 a. “Authority” means a department, or public or quasi-public 5 instrumentality of the state including but not limited to 6 the authority created under chapter 12E , 16 , 257C , or 261A , 7 or 463C , which has the power to issue obligations, except 8 that “authority” does not include the state board of regents 9 or the Iowa finance authority to the extent it acts pursuant 10 to chapter 260C . “Authority” also includes a port authority 11 created under chapter 28J . 12 Sec. 3. Section 422.7, subsection 2, paragraph v, Code 2019, 13 is amended by striking the paragraph. 14 Sec. 4. Section 461A.1, Code 2019, is amended by adding the 15 following new subsection: 16 NEW SUBSECTION . 4. “Honey creek resort state park” or 17 “resort” means the state’s premier destination state park 18 located on Rathbun lake. 19 Sec. 5. NEW SECTION . 461A.3A Honey creek resort state park 20 —— findings —— competitive bidding. 21 1. Honey creek resort state park is established to provide 22 important recreational and economic benefits to the state. 23 2. Competitive bid laws, including hearings in connection 24 with contracts, shall not apply to either the department’s or 25 its agents’ contracts involving or benefitting the resort if 26 the contract is carrying out a public or essential governmental 27 function. However, the exemption from competitive bid laws in 28 this section shall not be construed to apply to contracts for 29 the development or construction of facilities at the resort, 30 including but not limited to lodges, campgrounds, cabins, and 31 golf courses. 32 Sec. 6. REPEAL. Chapter 463C, Code 2019, is repealed. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -1- LSB 1244DP (4) 88 js/rn 1/ 2
S.F. _____ H.F. _____ the explanation’s substance by the members of the general assembly. 1 This bill repeals the honey creek premier destination park 2 bond program. 3 Current law creates within the department of natural 4 resources the honey creek premier destination park authority, 5 which implements and administers the honey creek premier 6 destination park bond program. The law requires the authority 7 to dissolve no later than two years after the date of final 8 payment of all outstanding bonds and the satisfaction of all 9 outstanding obligations of the authority, except to the extent 10 necessary to remain in existence to fulfill any outstanding 11 covenants or provisions with bondholders or third parties made 12 in accordance with Iowa Code chapter 463C. Upon dissolution, 13 all assets of the authority shall be deposited into the general 14 fund of the state unless otherwise directed by the general 15 assembly. 16 All outstanding bonds of the authority were defeased on 17 November 25, 2013, and subsequently redeemed on June 1, 2016. 18 The dissolution of the authority was effective June 1, 2018. 19 The bill makes conforming changes in the Iowa Code to remove 20 references to the authority. The bill also retains language 21 regarding competitive bidding that would otherwise have been 22 repealed. 23 -2- LSB 1244DP (4) 88 js/rn 2/ 2
