S.F. _____ Section 1. Section 137F.2, Code 2019, is amended to read as 1 follows: 2 137F.2 Adoption by rule. 3 1. The department shall, in accordance with chapter 17A , 4 adopt rules setting minimum standards for entities covered 5 under this chapter to protect consumers from foodborne 6 illness. In so doing, the department may adopt by reference, 7 with or without amendment, the United States food and drug 8 administration food code, which shall be specified by title 9 and edition, date of publication, or similar information. The 10 rules and standards shall be formulated in consultation with 11 municipal corporations under agreement with the department, 12 affected state agencies, and industry, professional, and 13 consumer groups. 14 2. In establishing minimum standards as described in 15 subsection 1, the department shall adopt rules for the sale at 16 a farmers market of culinary mushrooms commonly referred to as 17 a variety of wild golden oyster and classified as pleurotus 18 ostreatus, pleurotus populinus, or pleuotus pulmonarious. 19 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 20 importance, takes effect upon enactment. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill provides for the sale of wild golden oyster 25 mushrooms at farmers markets according to rules adopted by the 26 department of inspections and appeals.
