S.F. _____ Section 1. Section 481A.78, Code 2019, is amended by 1 striking the section and inserting in lieu thereof the 2 following: 3 481A.78 Stocking private water. 4 The commission shall not stock a private pond or lake. 5 However, the commission may stock a creek or stream flowing 6 through private property. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 Under current law, the natural resource commission may stock 11 private water only when the owner of the private water agrees 12 that such water shall be open to the public for fishing. The 13 commission may provide a breeding stock of fish for privately 14 owned farm ponds upon the request of the owner. 15 This bill prohibits the commission from stocking a private 16 lake or pond.
