Senate Resolution 113 - Introduced SENATE RESOLUTION NO. 113 BY WHITVER A Resolution amending Senate Rules for the 1 Eighty-eighth General Assembly. 2 BE IT RESOLVED BY THE SENATE, That Rule 2, of the 3 Senate rules for the Eighty-eighth General Assembly, as 4 adopted during the 2019 Session in Senate Resolution 5 3, is amended as follows: 6 Rule 2 7 Adoption and Amendment of Rules 8 Whenever the senate is operating under temporary 9 rules, the rules may be amended or repealed, or 10 permanent rules may be adopted, by a constitutional 11 majority of the senators. After adoption of permanent 12 rules of the senate during any general assembly, the 13 rules may be amended or repealed by a constitutional 14 majority of the senators voting on a simple resolution. 15 Upon convening of the Eighty-ninth General Assembly, 16 for purposes of adopting temporary rules, these rules 17 shall revert to the senate rules as adopted pursuant to 18 Senate Resolution 3 during the 2019 Session. 19 BE IT FURTHER RESOLVED, That Rule 8, of the Senate 20 rules for the Eighty-eighth General Assembly, as 21 adopted during the 2019 Session in Senate Resolution 22 3, is amended as follows: 23 Rule 8 24 When Eligible for Consideration 25 Bills, resolutions, and appointments shall be 26 eligible for consideration by the senate as follows: 27 1. S.R. 113 senate confirmation shall be eligible on the second 1 first legislative day it is printed in the senate 2 calendar as provided by rule 59. 3 2. A house or individually sponsored bill or 4 resolution reported out by a committee shall be 5 eligible on the second first legislative day it is 6 printed in the senate calendar. 7 3. A committee bill or resolution sponsored by 8 the appropriations committee shall be eligible on 9 the second first legislative day it is printed in the 10 senate calendar. 11 4. Any committee bill or resolution, other than 12 a bill or resolution sponsored by the appropriations 13 committee, shall be eligible on the third first 14 legislative day it is printed in the senate calendar. 15 5. A bill that has been reported out to the 16 senate calendar, referred to a different committee 17 and reported out by that committee is eligible for 18 consideration by the senate on the day it would have 19 been eligible under subsection 2, 3, or 4, whichever 20 is applicable, as if the bill had been printed in the 21 calendar after having been reported out by the first 22 committee. 23 BE IT FURTHER RESOLVED, That Rule 12, unnumbered 24 paragraph 2, of the Senate rules for the Eighty-eighth 25 General Assembly, as adopted during the 2019 Session in 26 Senate Resolution 3, is amended as follows: 27 No amendment, resolution, bill , or conference 28 committee report shall be considered by the senate 29 without a copy of the amendment, resolution, bill , or 30 -2- LSB 6416SS (4) 88 tm/jh 2/ 6
S.R. 113 conference committee report being on the desks of the 1 entire membership of the senate prior to consideration. 2 However, after the fourteenth week of the first session 3 and the twelfth week of the second session, amendments 4 and senate resolutions may be considered by the senate 5 without a copy of the amendment or senate resolution 6 being on the desks of the entire membership of the 7 senate if a copy of the amendment or senate resolution 8 is made available to the entire membership of the 9 senate electronically. However, such consideration 10 shall be deferred until a copy of the amendment 11 or senate resolution is on the desk of any senator 12 who so requests. An amendment or senate resolution 13 shall not be considered by the senate until a copy 14 of the amendment or senate resolution is distributed 15 electronically to each member of the senate and paper 16 copies are made available in the senate chamber. 17 BE IT FURTHER RESOLVED, That Rule 22, unnumbered 18 paragraphs 4 and 6, of the Senate rules for the 19 Eighty-eighth General Assembly, as adopted during the 20 2019 Session in Senate Resolution 3, are amended as 21 follows: 22 After sufficient time has ten minutes have elapsed 23 for all senators present to record their votes, the 24 president shall direct the secretary of the senate 25 to close the voting system. The president shall 26 still enter the senators’ votes at any time prior 27 to directing the secretary of the senate to lock the 28 voting system. S.R. 113 the senator’s vote within the ten minutes shall be 1 recorded as excused. 2 In the event the electronic voting system is not 3 in operating order, the president shall direct the 4 secretary of the senate to take the non-record or 5 record roll call by calling the names of the senators 6 in alphabetical order. In the event the senate camera 7 system is not in operating order, debate in the senate 8 shall continue provided live audio is available on the 9 general assembly’s internet site. 10 BE IT FURTHER RESOLVED, That Rule 41, of the Senate 11 rules for the Eighty-eighth General Assembly, as 12 adopted during the 2019 Session in Senate Resolution 13 3, is amended as follows: 14 Rule 41 15 Announcement of Committee Meetings 16 It shall be in order for the chair of any committee 17 to announce to the senate the time and place of 18 committee meetings. The announcement shall include a 19 proposed agenda for the meeting. The sergeant-at-arms 20 shall post at the rear of the chamber the daily 21 schedule of committee meetings. 22 BE IT FURTHER RESOLVED, That Rule 45, of the Senate 23 rules for the Eighty-eighth General Assembly, as 24 adopted during the 2019 Session in Senate Resolution 25 3, is amended as follows: 26 Rule 45 27 Access to Senate Chamber and Decorum 28 The persons who shall have access to the senate 29 chamber, and the times access shall be available, and 30 -4- LSB 6416SS (4) 88 tm/jh 4/ 6
S.R. 113 the rules governing activities in the chamber and other 1 areas controlled by the senate shall be as prescribed 2 by the rules and administration committee pursuant to a 3 written policy adopted by the committee and filed with 4 the secretary of the senate limited to members of the 5 general assembly and legislative staff . 6 BE IT FURTHER RESOLVED, That Rule 46, of the Senate 7 rules for the Eighty-eighth General Assembly, as 8 adopted during the 2019 Session in Senate Resolution 3, 9 is amended by striking the rule. 10 BE IT FURTHER RESOLVED, That Rule 59, unnumbered 11 paragraphs 4, 5, and 10, of the Senate rules for the 12 Eighty-eighth General Assembly, as adopted during the 13 2019 Session in Senate Resolution 3, are amended as 14 follows: 15 Within the three (3) legislative days after an 16 appointment has been referred to the rules and 17 administration committee, any ten senators may require 18 that the nominee be assigned to an appropriate standing 19 committee by filing a written, signed request therefor 20 with the chairperson of the rules and administration 21 committee. The committee chair shall refer the 22 appointment to a subcommittee within three (3) 23 legislative days after a standing committee receives 24 an appointment for further investigation, publishing 25 notice of such assignment in the senate journal for the 26 next legislative day. Within ten (10) legislative days 27 By June 6, 2020, after a standing committee receives an 28 appointment for further investigation the subcommittee 29 shall file its report with the standing committee. 30 -5- LSB 6416SS (4) 88 tm/jh 5/ 6
S.R. 113 Within fourteen (14) legislative days Not later than 1 June 6, 2020, after a standing committee receives an 2 appointment for further investigation, the committee 3 shall conduct an investigation of the nominee and 4 file its report thereon with the secretary of the 5 senate, who shall then place the nominee on the en 6 bloc calendar or individual confirmation calendar as 7 directed by the committee. The failure of a committee 8 to file its report within the prescribed time means 9 that the nominee is to be automatically placed, without 10 recommendation, upon the individual confirmation 11 calendar. 12 VOTING ON CONFIRMATIONS. Appointments received 13 from the governor by March 1 for senate confirmation 14 during any session of a general assembly shall be 15 acted upon by April 15 as provided by section 2.32 16 of the Code. Upon the motion of the majority leader 17 or his or her designee, the nominees on the en bloc 18 confirmation calendar shall be confirmed en bloc by the 19 affirmative vote of two-thirds of the members elected 20 to the senate. The journal shall reflect a single roll 21 call accompanied by a statement of the names of those 22 individuals subject to the en bloc confirmation vote. 23 BE IT FURTHER RESOLVED, That Rule 60, of the Senate 24 rules for the Eighty-eighth General Assembly, as 25 adopted during the 2019 Session in Senate Resolution 3, 26 is amended by striking the rule. 27 -6- LSB 6416SS (4) 88 tm/jh 6/ 6
