S.F. 629 Section 1. Section 321.463, subsection 3, Code 2019, is 1 amended to read as follows: 2 3. Notwithstanding other provisions of this chapter to 3 the contrary, indivisible loads operating under the permit 4 requirements of sections 321E.7 , 321E.8 , 321E.9 , and 321E.29A , 5 and divisible loads operating under the permit requirements of 6 section 321E.26, shall be allowed a maximum of twenty thousand 7 pounds per axle. 8 Sec. 2. Section 321E.3, Code 2019, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 3. Notwithstanding any other provision of 11 this chapter to the contrary, the department shall develop and 12 implement a single statewide system to receive applications 13 for and issue permits authorized under this chapter that allow 14 for the operation of vehicles of excessive size or weight on 15 highways or streets under the jurisdiction of the state or 16 local authorities. The department is authorized to determine, 17 in consultation with the applicable local authorities, the 18 network of highways and streets under the jurisdiction of 19 local authorities, including the appropriate routes, on which 20 vehicles issued permits under the system are authorized to 21 operate. Permits issued under the system shall be issued by 22 the department for a fee established by the department by rule, 23 which fees shall be proportionate to the fees set forth in 24 section 321E.14. The department shall allocate a portion of 25 the fees collected under this subsection to local authorities 26 having jurisdiction over highways or streets on which vehicles 27 issued permits under the system are authorized to operate. 28 Sec. 3. Section 321E.7, subsection 1, paragraph e, Code 29 2019, is amended to read as follows: 30 e. Vehicles operating under a permit issued pursuant to 31 section 321E.8 , 321E.9 , or 321E.9A , or 321E.26 may have a gross 32 weight not to exceed forty-six thousand pounds on a single 33 tandem axle of the truck tractor and a gross weight not to 34 exceed forty-six thousand pounds on a single tandem axle of the 35 -1- LSB 1051SZ (2) 88 ns/rh 1/ 5
S.F. 629 trailer or semitrailer if each axle of each tandem group has at 1 least four tires. 2 Sec. 4. Section 321E.9, Code 2019, is amended by adding the 3 following new subsection: 4 NEW SUBSECTION . 4. Containers for international shipment 5 shall be considered an indivisible load for purposes of 6 transportation under a permit issued pursuant to this section 7 if all of the following conditions are met: 8 a. The combination of vehicles transporting the container 9 under the permit does not exceed the maximum dimensions 10 specified in sections 321.454 through 321.457. 11 b. The container is sealed for international shipment and is 12 either in route for export to a foreign country or in route to 13 the container’s destination from a foreign country. 14 c. Documentation, such as a bill of lading or another 15 similar document, is carried in the vehicle, in written 16 or electronic form, that ties the container being moved to 17 the container listed in the documentation using the unique 18 container number marked on the container. The documentation 19 shall clearly state the foreign country of origin or 20 destination, and shall be provided to a peace officer upon 21 request. 22 d. The container’s contents are exclusively raw forest 23 products as defined in section 321E.26. 24 Sec. 5. Section 321E.14, subsection 1, Code 2019, is amended 25 by adding the following new paragraph: 26 NEW PARAGRAPH . j. One hundred seventy-five dollars for a 27 permit issued pursuant to section 321E.26. 28 Sec. 6. NEW SECTION . 321E.26 Transportation of raw forest 29 products. 30 1. The department may issue annual permits for the 31 operation of a vehicle or combination of vehicles transporting 32 divisible loads of raw forest products from fields to storage, 33 processing, or other commercial facilities. S.F. 629 vehicle or combination of vehicles issued a permit under this 1 section may exceed the maximum weights specified in section 2 321.463, if the gross weight on any one axle does not exceed 3 the limitations specified in section 321E.7. 4 2. A vehicle or combination of vehicles for which a permit 5 is issued under this section shall not exceed the maximum 6 dimensions specified in sections 321.454 through 321.457. 7 3. A vehicle or combination of vehicles for which a permit 8 is issued under this section shall not travel on any portion of 9 the interstate highway system. 10 4. Notwithstanding section 321E.3 or any other provision of 11 law to the contrary, a permit issued by the department pursuant 12 to this section is valid for the operation of a vehicle or 13 combination of vehicles on a nonprimary highway if the local 14 authority having jurisdiction over the nonprimary highway has 15 approved the route within the local authority’s jurisdiction 16 used by the vehicle or combination of vehicles traveling under 17 the permit. 18 5. For the purposes of this section, “raw forest products” 19 means logs, pilings, posts, poles, cordwood products, wood 20 chips, sawdust, pulpwood, intermediary lumber, fuel wood, 21 mulch, tree bark, and Christmas trees not altered by a 22 manufacturing process off the land, sawmill, or factory from 23 which the products were taken. 24 Sec. 7. REPORT. The department shall submit a report 25 to the general assembly in electronic form on or before 26 December 31, 2021, regarding the status of the development and 27 implementation of the system required under section 321E.3, 28 subsection 3, as enacted by this Act. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 STATEWIDE SYSTEM. This bill requires the department 33 of transportation (DOT) to develop and implement a single 34 statewide system to receive applications for and issue permits 35 -3- LSB 1051SZ (2) 88 ns/rh 3/ 5
S.F. 629 that allow for the operation of vehicles of excessive size 1 or weight on highways or streets under the jurisdiction of 2 the state or local authorities. The bill authorizes the 3 DOT to determine, in consultation with the applicable local 4 authorities, the network of highways and streets under the 5 jurisdiction of local authorities, including the appropriate 6 routes, on which vehicles issued permits under the system are 7 authorized to operate. Permits issued under the system must 8 be issued by the DOT for a fee established by the DOT by rule, 9 which fees must be proportionate to the fees set forth in 10 Code section 321E.14. The bill requires the DOT to allocate 11 a portion of the fees collected to local authorities having 12 jurisdiction over highways or streets on which vehicles issued 13 permits under the system are authorized to operate. The bill 14 requires the DOT to submit a report to the general assembly in 15 electronic form on or before December 31, 2021, regarding the 16 status of the development and implementation of the system. 17 RAW FOREST PRODUCTS. The bill provides that containers for 18 international shipment shall be considered an indivisible load 19 for purposes of transportation under a single-trip permit if 20 the combination of vehicles transporting the container under 21 the permit does not exceed the maximum dimensions specified in 22 Code sections 321.454 through 321.457; the container is sealed 23 for international shipment and is either in route for export to 24 a foreign country or in route to the container’s destination 25 from a foreign country; documentation is carried in the 26 vehicle, in written or electronic form, that ties the container 27 being moved to the container listed in the documentation using 28 the unique container number marked on the container; and the 29 container’s contents are exclusively raw forest products. The 30 bill requires the documentation carried in the vehicle to 31 clearly state the foreign country of origin or destination, and 32 to be provided to a peace officer upon request. 33 The bill allows the DOT to issue annual permits authorizing a 34 vehicle or combination of vehicles to transport divisible loads 35 -4- LSB 1051SZ (2) 88 ns/rh 4/ 5
S.F. 629 of raw forest products from fields to storage, processing, or 1 other commercial facilities. The annual permit fee is $175. 2 A vehicle or combination of vehicles for which a permit is 3 issued under the bill may exceed the maximum weights set forth 4 under Code section 321.463 if the gross weight on any one axle 5 does not exceed the limitations specified in Code section 6 321E.7. Code section 321E.7 limits the gross weight on any one 7 axle to 20,000 pounds and the gross weight on any one tandem 8 axle having at least four tires to 46,000 pounds. The bill 9 prohibits a vehicle or combination of vehicles issued such a 10 permit from exceeding the size limitations set forth in Code 11 sections 321.454 through 321.457. The bill also prohibits a 12 vehicle or combination of vehicles for which a permit is issued 13 under the bill from traveling on any portion of the interstate 14 highway system. The bill provides that such a permit issued 15 by the DOT is valid for operation on nonprimary highways if 16 the local authority having jurisdiction over the nonprimary 17 highway has approved the route within the local authority’s 18 jurisdiction used by the vehicle or combination of vehicles 19 traveling under the permit. 20 The bill defines “raw forest products” to mean logs, 21 pilings, posts, poles, cordwood products, wood chips, sawdust, 22 pulpwood, intermediary lumber, fuel wood, mulch, tree bark, and 23 Christmas trees not altered by a manufacturing process off the 24 land, sawmill, or factory from which the products were taken. 25 -5- LSB 1051SZ (2) 88 ns/rh 5/ 5
