Notwithstanding 2017 31 Iowa Acts, chapter 168, section 22 , as amended by 2017 Iowa 32 Acts, chapter 170, section 42 , of the moneys credited to the 33 watershed improvement fund that are unencumbered or unobligated 34 and managed by and otherwise appropriated to the department of 35 -2- LSB 1001SV (6) 88 da/tm 2/ 31

Notwithstanding section 8.33 , moneys appropriated in 14 this section that remain unencumbered or unobligated at the 15 close of the fiscal year shall not revert but shall remain 16 available to be used for the purposes designated until the 17 close of the succeeding fiscal year. 18 Sec. 7. AGRICULTURAL EDUCATION. 19 1. The moneys appropriated in subsection 1 shall be used for 8 the public purpose of providing a grant to a national nonprofit 9 organization with over 80 years of experience in assisting 10 children and adults with disabilities and special needs. The 11 moneys shall be used to support a nationally recognized program 12 that began in 1986 and has been replicated in at least 30 other 13 states, but which is not available through any other entity 14 in this state, and that provides assistance to farmers with 15 disabilities in all 99 counties to allow the farmers to remain 16 in their own homes and be gainfully engaged in farming through 17 provision of agricultural worksite and home modification 18 consultations, peer support services, services to families, 19 information and referral, and equipment loan services. 20 3. Notwithstanding section 8.33 , moneys appropriated in 21 this section that remain unencumbered or unobligated at the 22 close of the fiscal year shall not revert but shall remain 23 available for expenditure for the purposes designated until the 24 close of the succeeding fiscal year. 25 Sec. 9. FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK. 26 There is appropriated from the general fund of the state to the 27 department of agriculture and land stewardship for the fiscal 28 year beginning July 1, 2019, and ending June 30, 2020, the 29 following amount, or so much thereof as is necessary, to be 30 used for the purposes designated: 31 For deposit in the foreign animal disease preparedness and 32 response fund created in section 163.3B : 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 500,000 34 DIVISION II 35 -5- LSB 1001SV (6) 88 da/tm 5/ 31
S.F. 609 GENERAL FUND 1 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 2 WATER QUALITY INITIATIVE 3 Sec. 10. WATER QUALITY INITIATIVE —— GENERAL. 4 1. There is appropriated from the general fund of the state 5 to the department of agriculture and land stewardship for the 6 fiscal year beginning July 1, 2019, and ending June 30, 2020, 7 the following amount, or so much thereof as is necessary, to be 8 used for the purposes designated: 9 For deposit in the water quality initiative fund created in 10 section 466B.45 , for purposes of supporting the water quality 11 initiative administered by the division of soil conservation 12 and water quality as provided in section 466B.42 , including 13 salaries, support, maintenance, and miscellaneous purposes: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 15 2. a. The moneys appropriated in subsection 1 shall be 16 used to support projects in subwatersheds as designated by the 17 division that are part of high-priority watersheds identified 18 by the water resources coordinating council established 19 pursuant to section 466B.3 . 20 b. The moneys appropriated in subsection 1 shall be used to 21 support projects in watersheds generally, including regional 22 watersheds, as designated by the division and high-priority 23 watersheds identified by the water resources coordinating 24 council established pursuant to section 466B.3. 25 3. In supporting projects in subwatersheds and watersheds 26 as provided in subsection 2, all of the following shall apply: 27 a. The demonstration projects shall utilize water quality 28 practices as described in the Iowa nutrient reduction strategy 29 as defined in section 455B.171 . 30 b. The division shall implement demonstration projects as 31 provided in paragraph “a” by providing for participation by 32 persons who hold a legal interest in agricultural land used in 33 farming. To every extent practical, the division shall provide 34 for collaborative participation by such persons who hold a 35 -6- LSB 1001SV (6) 88 da/tm 6/ 31
S.F. 609 legal interest in agricultural land located within the same 1 subwatershed. 2 c. The division shall implement a demonstration project on 3 a cost-share basis as determined by the division. However, 4 except for edge-of-field practices, the state’s share of the 5 amount shall not exceed 50 percent of the estimated cost of 6 establishing the practice as determined by the division or 7 50 percent of the actual cost of establishing the practice, 8 whichever is less. 9 d. The demonstration projects shall be used to educate other 10 persons about the feasibility and value of establishing similar 11 water quality practices. The division shall promote field day 12 events for purposes of allowing interested persons to establish 13 water quality practices on their agricultural land. 14 e. The division shall conduct water quality evaluations 15 within supported subwatersheds. Within a reasonable period 16 after accumulating information from such evaluations, the 17 division shall create an aggregated database of water quality 18 practices. Any information identifying a person holding a 19 legal interest in agricultural land or specific agricultural 20 land shall be a confidential record under section 22.7 . 21 4. The moneys appropriated in subsection 1 shall be used 22 to support education and outreach in a manner that encourages 23 persons who hold a legal interest in agricultural land used for 24 farming to implement water quality practices, including the 25 establishment of such practices in watersheds generally, and 26 not limited to subwatersheds or high-priority watersheds. 27 5. The moneys appropriated in subsection 1 may be used 28 to contract with persons to coordinate the implementation of 29 efforts provided in this section. 30 6. The moneys appropriated in subsection 1 may be used by 31 the department to support urban soil and water conservation 32 efforts, which may include but are not limited to management 33 practices related to bioretention, landscaping, the use of 34 permeable or pervious pavement, and soil quality restoration. 35 -7- LSB 1001SV (6) 88 da/tm 7/ 31
S.F. 609 The moneys shall be allocated on a cost-share basis as provided 1 in chapter 161A. 2 7. Notwithstanding any other provision of law to the 3 contrary, the department may use moneys appropriated in 4 subsection 1 to carry out the provisions of this section on a 5 cost-share basis in combination with other moneys available to 6 the department from a state or federal source. 7 8. Not more than 10 percent of the moneys appropriated in 8 this section may be used to pay for the costs of administering 9 and implementing the water quality initiative by the 10 department’s division of soil conservation and water quality as 11 provided in section 466B.42 and this section. 12 DIVISION III 13 DEPARTMENT OF NATURAL RESOURCES 14 Sec. 11. GENERAL FUND —— DEPARTMENT. 15 1. There is appropriated from the general fund of the state 16 to the department of natural resources for the fiscal year 17 beginning July 1, 2019, and ending June 30, 2020, the following 18 amount, or so much thereof as is necessary, to be used for the 19 purposes designated: 20 For purposes of supporting the department, including its 21 divisions, for administration, regulation, and programs; for 22 salaries, support, maintenance, and miscellaneous purposes; and 23 for not more than the following full-time equivalent positions: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,554,987 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Of the number of full-time equivalent positions 27 authorized to the department pursuant to subsection 1, 50 28 full-time equivalent positions shall be allocated by the 29 department for seasonal employees for purposes of providing 30 maintenance, upkeep, and sanitary services at state parks. 31 This subsection shall not impact park ranger or park manager 32 positions within the department. 33 3. The department shall submit a report each quarter of the 34 fiscal year to the legislative services agency, the department 35 -8- LSB 1001SV (6) 88 da/tm 8/ 31

The report shall describe in 4 detail the expenditure of moneys appropriated under this 5 section to support the department’s administration, regulation, 6 and programs. 7 Sec. 12. STATE FISH AND GAME PROTECTION FUND —— REGULATION 8 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 9 1. There is appropriated from the state fish and game 10 protection fund created pursuant to section 456A.17 to the 11 department of natural resources for the fiscal year beginning 12 July 1, 2019, and ending June 30, 2020, the following amount, 13 or so much thereof as is necessary, to be used for the purposes 14 designated: 15 For purposes of supporting the regulation or advancement of 16 hunting, fishing, or trapping, or the protection, propagation, 17 restoration, management, or harvest of fish or wildlife, 18 including for administration, regulation, law enforcement, and 19 programs; and for salaries, support, maintenance, equipment, 20 and miscellaneous purposes: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 44,007,044 22 2. Notwithstanding section 455A.10 , the department may use 23 the unappropriated balance remaining in the state fish and game 24 protection fund to provide for the funding of health and life 25 insurance premium payments from unused sick leave balances of 26 conservation peace officers employed in a protection occupation 27 who retire, pursuant to section 97B.49B . 28 3. Notwithstanding section 455A.10 , the department of 29 natural resources may use the unappropriated balance remaining 30 in the state fish and game protection fund for the fiscal 31 year beginning July 1, 2019, and ending June 30, 2020, as is 32 necessary to fund salary adjustments for departmental employees 33 for which the general assembly has made an operating budget 34 appropriation in subsection 1. 35 -9- LSB 1001SV (6) 88 da/tm 9/ 31

Paragraph “a” does not apply to a reduction made to 21 support the college of veterinary medicine, if the same 22 percentage of reduction imposed on the college of veterinary 23 medicine is also imposed on all of Iowa state university of 24 science and technology’s budget units. 25 3. If by June 30, 2020, Iowa state university of science and 26 technology fails to allocate the moneys appropriated in this 27 section to the college of veterinary medicine in accordance 28 with this section, the moneys appropriated in this section for 29 that fiscal year shall revert to the general fund of the state. 30 DIVISION V 31 ENVIRONMENT FIRST FUND 32 GENERAL APPROPRIATIONS 33 Sec. 19. Subsection 1 does not apply to moneys transferred 8 pursuant to this division to the loess hills development and 9 conservation fund created in section 161D.2 which shall not 10 revert as provided in that section. 11 DIVISION VI 12 ENVIRONMENT FIRST FUND 13 SPECIAL APPROPRIATIONS 14 Sec. 23. WATER QUALITY INITIATIVE —— DEPARTMENT OF 15 AGRICULTURE AND LAND STEWARDSHIP. 16 1. There is appropriated from the environment first fund 17 created in section 8.57A to the department of agriculture 18 and land stewardship for the fiscal year beginning July 1, 19 2019, and ending June 30, 2020, the following amount, or so 20 much thereof as is necessary, to be used for the purposes 21 designated: 22 For deposit in the water quality initiative fund created in 23 section 466B.45 , for purposes of supporting the water quality 24 initiative administered by the division of soil conservation 25 and water quality as provided in section 466B.42 , including 26 salaries, support, maintenance, and miscellaneous purposes: 27 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,375,000 28 2. a. The moneys appropriated in subsection 1 shall be 29 used to support projects in subwatersheds as designated by the 30 division that are part of high-priority watersheds identified 31 by the water resources coordinating council established 32 pursuant to section 466B.3 . 33 b. The moneys appropriated in subsection 1 shall be used to 34 support projects in watersheds generally, including regional 35 -18- LSB 1001SV (6) 88 da/tm 18/ 31
S.F. 609 watersheds, as designated by the division and high-priority 1 watersheds identified by the water resources coordinating 2 council established pursuant to section 466B.3. 3 3. In supporting projects in subwatersheds and watersheds 4 as provided in subsection 2, all of the following shall apply: 5 a. The demonstration projects shall utilize water quality 6 practices as described in the Iowa nutrient reduction strategy 7 as defined in section 455B.171 . 8 b. The division shall implement demonstration projects as 9 provided in paragraph “a” by providing for participation by 10 persons who hold a legal interest in agricultural land used in 11 farming. To every extent practical, the division shall provide 12 for collaborative participation by such persons who hold a 13 legal interest in agricultural land located within the same 14 subwatershed. 15 c. The division shall implement a demonstration project on 16 a cost-share basis as determined by the division. However, 17 except for edge-of-field practices, the state’s share of the 18 amount shall not exceed 50 percent of the estimated cost of 19 establishing the practice as determined by the division or 20 50 percent of the actual cost of establishing the practice, 21 whichever is less. 22 d. The demonstration projects shall be used to educate other 23 persons about the feasibility and value of establishing similar 24 water quality practices. The division shall promote field day 25 events for purposes of allowing interested persons to establish 26 water quality practices on their agricultural land. 27 e. The division shall conduct water quality evaluations 28 within supported subwatersheds. Within a reasonable period 29 after accumulating information from such evaluations, the 30 division shall create an aggregated database of water quality 31 practices. Any information identifying a person holding a 32 legal interest in agricultural land or specific agricultural 33 land shall be a confidential record under section 22.7 . 34 4. The moneys appropriated in subsection 1 shall be used 35 -19- LSB 1001SV (6) 88 da/tm 19/ 31
S.F. 609 to support education and outreach in a manner that encourages 1 persons who hold a legal interest in agricultural land used for 2 farming to implement water quality practices, including the 3 establishment of such practices in watersheds generally, and 4 not limited to subwatersheds or high-priority watersheds. 5 5. The moneys appropriated in subsection 1 may be used 6 to contract with persons to coordinate the implementation of 7 efforts provided in this section. 8 6. The moneys appropriated in subsection 1 may be used by 9 the department to support urban soil and water conservation 10 efforts, which may include but are not limited to management 11 practices related to bioretention, landscaping, the use of 12 permeable or pervious pavement, and soil quality restoration. 13 The moneys shall be allocated on a cost-share basis as provided 14 in chapter 161A. 15 7. Notwithstanding any other provision of law to the 16 contrary, the department may use moneys appropriated in 17 subsection 1 to carry out the provisions of this section on a 18 cost-share basis in combination with other moneys available to 19 the department from a state or federal source. 20 8. Not more than 10 percent of the moneys appropriated in 21 this section may be used to pay for the costs of administering 22 and implementing the water quality initiative by the 23 department’s division of soil conservation and water quality as 24 provided in section 466B.42 and this section. 25 Sec. 24. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. NEW SECTION . 214A.2C Auditing programs. 2 The department shall establish and administer programs 3 for the auditing of motor fuel including biofuel processing 4 and production plants, for screening and testing motor fuel, 5 including renewable fuel, and for the inspection of motor fuel 6 sold by dealers, including retail dealers who sell and dispense 7 motor fuel from motor fuel pumps. 8 DIVISION VIII 9 RELATED CODE CHANGES —— DEPARTMENT OF NATURAL RESOURCES —— AIR 10 QUALITY FUND 11 Sec. 26. Section 455B.133C, subsection 6, paragraph c, Code 12 2019, is amended to read as follows: 13 c. The department’s calculated estimate for the minor source 14 account shall not produce total revenues in excess of two seven 15 hundred fifty thousand dollars during any state fiscal year. 16 DIVISION IX 17 RELATED CODE CHANGES —— FUTURE REPEAL OF MERCURY THERMOSTAT 18 REGULATION 19 Sec. 27. Section 455D.16, Code 2019, is amended to read as 20 follows: 21 455D.16 Mercury —— thermostats. 22 1. As used in this section , unless the context otherwise 23 requires: 24 a. (1) “Manufacturer” means any person, firm, association, 25 partnership, corporation, governmental entity, organization, 26 combination, or joint venture that owns or owned the brand name 27 of the thermostat. 28 (2) This paragraph “a” is repealed on January 1, 2022. 29 b. “Mercury-added thermostat” means a product or device 30 that uses a mercury switch to sense and control room 31 temperature through communication with heating, ventilating, 32 or air-conditioning equipment. “Mercury-added thermostat” 33 includes thermostats used to sense and control room temperature 34 in residential, commercial, industrial, and other buildings 35 -21- LSB 1001SV (6) 88 da/tm 21/ 31
S.F. 609 but does not include thermostats used to sense and control 1 temperature as part of a manufacturing process. 2 c. (1) “Thermostat retailer” means a person who sells 3 thermostats of any kind directly to homeowners or other 4 nonprofessionals through any selling or distribution mechanism, 5 including but not limited to sales using the internet or 6 catalogues. A thermostat retailer may also be a thermostat 7 wholesaler if it meets the definition of thermostat wholesaler. 8 (2) This paragraph “c” is repealed on January 1, 2022. 9 d. (1) “Thermostat wholesaler” means a person who is 10 engaged in the distribution and wholesale selling of large 11 quantities of heating, ventilation, and air-conditioning 12 components, including thermostats, to contractors who install 13 heating, ventilation, and air-conditioning components, 14 including thermostats. 15 (2) This paragraph “d” is repealed on January 1, 2022. 16 2. Beginning July 1, 2009, a A person shall not sell, offer 17 for sale, or install a mercury-added thermostat in this state. 18 3. Beginning April 1, 2009, except Except as otherwise 19 provided, a person who generates a discarded mercury-added 20 thermostat shall manage the mercury-added thermostat as a 21 hazardous waste or universal hazardous waste, according to all 22 applicable state and federal regulations. A contractor who 23 replaces or removes mercury-added thermostats shall assure that 24 any discarded mercury-added thermostat is subject to proper 25 separation and management as hazardous waste or universal 26 hazardous waste. A contractor who replaces a mercury-added 27 thermostat in a residence shall deliver the mercury-added 28 thermostat to an appropriate collection location for recycling. 29 4. a. Each thermostat manufacturer that has offered for 30 final sale, sold at final sale, or distributed mercury-added 31 thermostats in the state shall individually, or in conjunction 32 with other thermostat manufacturers, do all of the following: 33 a. (1) Not later than October 1, 2008, submit a plan to 34 the department for approval describing a collection program for 35 -22- LSB 1001SV (6) 88 da/tm 22/ 31
S.F. 609 mercury-added thermostats. The program contained in the plan 1 shall ensure that all the following take place: 2 (1) (a) That an education and outreach program is 3 developed. The program shall be directed toward thermostat 4 wholesalers, thermostat retailers, contractors, and homeowners 5 and ensure a maximum rate of collection of mercury-added 6 thermostats. There shall not be a cost to thermostat 7 wholesalers or thermostat retailers for education and outreach 8 materials. 9 (2) (b) That handling and recycling of mercury-added 10 thermostats are accomplished in a manner that is consistent 11 with the provisions of the universal waste rules. 12 (3) (c) That containers for mercury-added thermostat 13 collection are provided to all thermostat wholesalers. The 14 cost to thermostat wholesalers for such containers shall be 15 limited to an initial, reasonable, one-time fee per container 16 as specified in the plan. 17 (4) (d) That collection points will be established to serve 18 homeowners. The collection points shall include but are not 19 limited to regional collection centers permitted under 567 IAC 20 ch. 123. Collection points may include but are not limited to 21 thermostat retailers. 22 (5) (e) That collection systems are provided to all 23 collection points. Collection systems may include individual 24 product mail back or multiple collection containers. The costs 25 of collection shall not be passed on to a collection point. 26 The costs to a collection point shall be limited to an initial, 27 reasonable, one-time fee per container as specified in the 28 plan. 29 b. (2) Not later than April 1, 2009, implement Implement 30 a mercury-added thermostat collection plan approved by the 31 department. 32 c. (3) Beginning in 2010, submit an annual report to the 33 department by April 1 of each year that includes, at a minimum, 34 all of the following: 35 -23- LSB 1001SV (6) 88 da/tm 23/ 31
S.F. 609 (1) (a) The number of mercury-added thermostats collected 1 and recycled by that manufacturer during the previous calendar 2 year. 3 (2) (b) The estimated total amount of mercury contained in 4 the thermostat components collected by that manufacturer during 5 the previous calendar year. 6 (3) (c) A list of all participating thermostat wholesalers 7 and all collection points for homeowners. 8 (4) (d) An evaluation of the effectiveness of the 9 manufacturer’s collection program. 10 (5) (e) An accounting of the administrative costs incurred 11 in the course of administering the collection and recycling 12 program. 13 b. This subsection is repealed on January 1, 2022. 14 5. a. (1) By April 1, 2009, a A thermostat wholesaler 15 shall do both all of the following: 16 (1) (a) Act as a collection site for mercury-added 17 thermostats. 18 (2) (b) Promote and utilize the collection containers 19 provided by thermostat manufacturers to facilitate a contractor 20 collection program. 21 b. (2) By April 1, 2009, a A thermostat retailer shall 22 participate in an education and outreach program to educate 23 consumers on the collection program for mercury-added 24 thermostats. 25 b. This subsection is repealed on January 1, 2022. 26 6. a. Beginning April 1, 2009, all All of the following 27 sales prohibitions shall apply to thermostat manufacturers, 28 thermostat wholesalers, and thermostat retailers: 29 a. (1) A thermostat manufacturer not in compliance with 30 this section is prohibited from offering any thermostat for 31 final sale in the state. A thermostat manufacturer not in 32 compliance with this section shall provide the necessary 33 support to thermostat wholesalers and thermostat retailers to 34 ensure the manufacturer’s thermostats are not offered for final 35 -24- LSB 1001SV (6) 88 da/tm 24/ 31
S.F. 609 sale. 1 b. (2) A thermostat wholesaler or thermostat retailer shall 2 not offer for final sale any thermostat of a manufacturer that 3 is not in compliance with this section . 4 b. This subsection is repealed on January 1, 2022. 5 7. a. The department shall do all of the following: 6 a. (1) Review and grant approval of, deny, or approve with 7 modifications a manufacturer plan required under this section . 8 The department shall not approve a plan unless all elements of 9 subsection 4 , paragraph “a” , subparagraph (1) are adequately 10 addressed and the program outlined in the plan will assure a 11 maximum rate of collection of mercury-added thermostats. In 12 reviewing a plan the department may consider consistency of 13 the plan with collection requirements in other states and 14 consider consistency between thermostat manufacturer collection 15 programs. In reviewing plans, the agency shall ensure that 16 education and outreach programs are uniform and consistent to 17 ensure ease of implementation by thermostat wholesalers and 18 thermostat retailers. 19 b. (2) The department shall establish a process for 20 public review and comment on all plans submitted by thermostat 21 manufacturers prior to plan approval. The department shall 22 consult with interested persons, including representatives of 23 thermostat manufacturers, environmental groups, thermostat 24 wholesalers, thermostat retailers, contractors, and local 25 government. 26 b. This subsection is repealed on January 1, 2022. 27 8. a. The goal of the collection and recycling efforts 28 under this section is to collect and recycle as many 29 mercury-added thermostats as reasonably practicable. By 30 January 1, 2009, the department shall determine collection 31 goals for the program in consultation with interested persons, 32 including the national electrical manufacturers association 33 and representatives of thermostat manufacturers, thermostat 34 wholesalers, thermostat retailers, contractors, environmental 35 -25- LSB 1001SV (6) 88 da/tm 25/ 31
S.F. 609 groups, and local government. If collection efforts fail to 1 meet the collection goals described in this subsection , the 2 department shall, in consultation with the national electrical 3 manufacturers association and other interested persons, 4 consider modifications to collection programs in an attempt to 5 improve collection rates in accordance with these goals. 6 b. This subsection is repealed on January 1, 2022. 7 DIVISION X 8 RELATED CODE CHANGES —— STATE UNIVERSITY OF IOWA —— IOWA 9 GEOLOGICAL SURVEY 10 Sec. 28. Section 352.4, subsection 4, Code 2019, is amended 11 to read as follows: 12 4. The state department of agriculture and land 13 stewardship, department of management, department of natural 14 resources, Iowa geological survey, state agricultural extension 15 service, and the economic development authority shall, upon 16 request, provide to each county commission any pertinent land 17 use information available to assist in the compiling of the 18 county land use inventories. 19 Sec. 29. Section 456.1, Code 2019, is amended to read as 20 follows: 21 456.1 Geological Iowa geological survey created. 22 A An Iowa geological survey of the state is created within 23 the state university of Iowa, under the jurisdiction and 24 authority of the state board of regents. 25 Sec. 30. Section 456.10, Code 2019, is amended to read as 26 follows: 27 456.10 Distribution of reports. 28 All publications of the Iowa geological survey shall be made 29 available electronically via an internet site maintained for 30 that purpose. 31 Sec. 31. Section 456.13, Code 2019, is amended to read as 32 follows: 33 456.13 Maps property of state —— custody —— copies. 34 The maps so delivered to the state geologist shall be the 35 -26- LSB 1001SV (6) 88 da/tm 26/ 31
S.F. 609 property of the state and shall remain in the custody of the 1 state geologist. They shall be kept at the office of the Iowa 2 geological survey and be open to examination by all persons 3 interested in the maps; but such examination shall only be made 4 in the presence of the state geologist or a designee, and the 5 state geologist shall not permit any copies of the maps to be 6 made without the written consent of the operator or the owner 7 of the property, except as provided in section 456.11 or if the 8 mine has been abandoned for at least five years. 9 DIVISION XI 10 WAREHOUSE OPERATORS —— LIEN 11 Sec. 32. Section 554.7209, Code 2019, is amended by adding 12 the following new subsection: 13 NEW SUBSECTION . 3A. Notwithstanding any provision in 14 this section to the contrary, a warehouse’s lien created in 15 subsection 1, that is in favor of a warehouse operator licensed 16 under either chapter 203C or the United States Warehouse Act, 7 17 U.S.C. ch. 10, is effective against all persons and is superior 18 against all other competing security interests and agricultural 19 liens. 20 Sec. 33. EFFECTIVE DATE. This division of this Act, being 21 deemed of immediate importance, takes effect upon enactment. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 GENERAL. This bill relates to agriculture and natural 26 resources by making appropriations for the fiscal year 27 2019-2020 to support related entities, including the department 28 of agriculture and land stewardship (DALS), the department of 29 natural resources (DNR), and Iowa state university (ISU), and 30 the university of Iowa (UI). 31 The bill primarily appropriates moneys to DALS and DNR. 32 The appropriations are made to support those departments for 33 administration, regulation, and support of programs. The bill 34 requires the departments to submit quarterly reports to the 35 -27- LSB 1001SV (6) 88 da/tm 27/ 31
S.F. 609 general assembly and department of management regarding the 1 expenditure of appropriated moneys. The bill also provides 2 moneys to support specific programs or projects administered 3 by those departments. The bill appropriates moneys from a 4 number of sources, including the general fund of the state 5 (general fund), the state fish and game protection fund, the 6 groundwater protection fund, and the environment first fund 7 (EFF). Appropriations are made from a number of sources to 8 support the water quality initiative (WQI). The bill is 9 organized into divisions. 10 DALS —— GENERAL FUND APPROPRIATIONS. The bill appropriates 11 moneys to DALS from the general fund in order to support its 12 administrative divisions, including consumer protection and 13 industry services, soil conservation, and food safety and 14 animal health. Moneys are transferred to ISU to support its 15 midwest grape and wine institute. Moneys are also transferred 16 to ISU to support the college of veterinary medicine for the 17 operation of the veterinary diagnostic laboratory, contingent 18 upon the enactment of 2019 Iowa Acts, senate file 601. 19 DALS —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 20 The bill appropriates moneys from several sources to support a 21 number of designated purposes, including moneys derived from 22 unclaimed winnings from horse and dog races, for administration 23 and enforcement of racing regulations; and moneys credited 24 to the renewable fuel infrastructure fund, for purposes of 25 regulating motor fuel. The bill appropriates an amount of 26 moneys remaining in the watershed improvement fund to support 27 the continuation of a statewide voluntary farm management 28 demonstration program. 29 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill also 30 makes special appropriations from the general fund to DALS in 31 order to support specific purposes including milk inspection, 32 the local food and farm program, an agricultural education 33 organization, assistance to farmers with disabilities, and for 34 foreign animal disease preparedness. 35 -28- LSB 1001SV (6) 88 da/tm 28/ 31
S.F. 609 DALS —— GENERAL FUND APPROPRIATIONS —— WATER QUALITY. The 1 bill appropriates moneys from the general fund to DALS for 2 deposit in the water quality initiative fund, to support the 3 WQI including high-priority watershed projects. The bill 4 appropriates moneys from the general fund to DALS for deposit 5 in the agricultural drainage well water quality assistance fund 6 for purposes of supporting the agricultural drainage well water 7 quality assistance program. 8 DNR —— GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS. 9 The bill makes appropriations from a number of funds to DNR in 10 order to support its administrative divisions involving natural 11 resources and environmental protection from the general fund, 12 the state fish and game protection fund, and the groundwater 13 protection fund. 14 DNR —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 15 The bill appropriates moneys to DNR from a number of sources 16 to support designated purposes, including moneys deposited in 17 the special snowmobile fund to provide for administering and 18 enforcing the state snowmobile programs; and moneys deposited 19 in the unassigned revenue fund for purposes of paying for 20 administration of DNR’s underground storage tanks section. 21 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill also 22 makes special appropriations from the general fund to DNR 23 in order to support specific purposes including floodplain 24 management and dam safety and forestry health management 25 programs. 26 ISU —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill 27 appropriates moneys from the general fund to ISU to support the 28 operation of its veterinary diagnostic laboratory. 29 DALS, DNR, AND UI —— EFF —— GENERAL APPROPRIATIONS. The 30 bill appropriates moneys from the EFF to support a number of 31 programs administered by DALS, DNR, and UI. For DALS, the 32 moneys are appropriated to support programs involving soil 33 conservation, watershed protection and nutrient management, 34 and the loess hills development and conservation fund. S.F. 609 DNR, moneys are appropriated to support programs involving 1 state parks, geographic information systems, water quality 2 monitoring, public water supplies, regulation of animal feeding 3 operations, air quality, and floodplain management and dam 4 safety. For UI, moneys are appropriated to support the Iowa 5 geological survey. The bill includes provisions that delay the 6 reversion of these moneys. 7 EFF —— SPECIAL APPROPRIATIONS FOR WQI. The bill 8 appropriates moneys from the EFF to the water quality 9 initiative fund subject to the same conditions applicable to 10 moneys appropriated to the fund from the general fund. 11 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND —— EFF 12 APPROPRIATION IN LIEU OF GENERAL FUND APPROPRIATION. An amount 13 of moneys is appropriated from the EFF to the REAP fund instead 14 of the $20,000,000 otherwise required to be appropriated to the 15 fund from the general fund. 16 RELATED CODE CHANGES —— PROGRAMS TO AUDIT MOTOR FUEL. The 17 provisions in the bill that authorize DALS to establish and 18 administer programs for auditing motor fuel production and 19 processing, motor fuel screening and testing, and inspection of 20 motor fuel sold by dealers is codified. The provision has been 21 included in previous appropriation bills since 2006. 22 RELATED CODE CHANGES —— DNR —— AIR QUALITY FUND. The bill 23 increases the amount of fees that DNR can impose and collect 24 for deposit in the minor source account of the air quality 25 fund. 26 RELATED CODE CHANGES —— FUTURE REPEAL OF MERCURY THERMOSTAT 27 REGULATION. The bill eliminates certain regulations relating 28 to the discontinuance of mercury thermostats. 29 RELATED CODE CHANGES —— IOWA GEOLOGICAL SURVEY. The name 30 of the geological survey of the state is changed to the Iowa 31 geological survey to comply with current naming conventions. 32 RELATED CODE CHANGES —— WAREHOUSE OPERATORS LIEN. The bill 33 provides that a grain warehouse operator possessing grain has a 34 lien superior to other creditors. This provision takes effect 35 -30- LSB 1001SV (6) 88 da/tm 30/ 31
