There is appropriated from the general fund of the state 2 to the department of cultural affairs for the fiscal year 3 beginning July 1, 2019, and ending June 30, 2020, the following 4 amounts, or so much thereof as is necessary, to be used for the 5 purposes designated: 6 a. GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 19 1. For the fiscal year beginning July 1, 2019, the goals 20 for the economic development authority shall be to expand and 21 stimulate the state economy, increase the wealth of Iowans, and 22 increase the population of the state. 23 2. To achieve the goals in subsection 1, the economic 24 development authority shall do all of the following for the 25 fiscal year beginning July 1, 2019: 26 a. Concentrate its efforts on programs and activities that 27 result in commercially viable products and services. 28 b. Adopt practices and services consistent with free 29 market, private sector philosophies. 30 c. Ensure economic growth and development throughout the 31 state. 32 d. Work with businesses and communities to continually 33 improve the economic development climate along with the 34 economic well-being and quality of life for Iowans. 35 -2- LSB 1002SV (2) 88 ko/tm 2/ 22
S.F. 608 e. Coordinate with other state agencies to ensure that they 1 are attentive to the needs of an entrepreneurial culture. 2 f. Establish a strong and aggressive marketing image to 3 showcase Iowa’s workforce, existing industry, and potential. 4 A priority shall be placed on recruiting new businesses, 5 business expansion, and retaining existing Iowa businesses. 6 Emphasis shall be placed on entrepreneurial development through 7 helping entrepreneurs secure capital, and developing networks 8 and a business climate conducive to entrepreneurs and small 9 businesses. 10 g. Encourage the development of communities and quality of 11 life to foster economic growth. 12 h. Prepare communities for future growth and development 13 through development, expansion, and modernization of 14 infrastructure. 15 i. Develop public-private partnerships with Iowa businesses 16 in the tourism industry, Iowa tour groups, Iowa tourism 17 organizations, and political subdivisions in this state to 18 assist in the development of advertising efforts. 19 j. Develop, to the fullest extent possible, cooperative 20 efforts for advertising with contributions from other sources. 21 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 22 1. APPROPRIATION 23 a. S.F. 608 and other divisions the authority may organize. 1 (2) The full-time equivalent positions authorized under 2 this section are funded, in whole or in part, by the moneys 3 appropriated under this subsection or by other moneys received 4 by the authority, including certain federal moneys. 5 (3) For business development operations and programs, 6 international trade, export assistance, workforce recruitment, 7 and the partner state program. 8 (4) For transfer to a fund created pursuant to section 9 15.313 for purposes of financing strategic infrastructure 10 projects. 11 (5) For community economic development programs, tourism 12 operations, community assistance, plans for Iowa green corps 13 and summer youth programs, the mainstreet and rural mainstreet 14 programs, the school-to-career program, the community 15 development block grant, and housing and shelter-related 16 programs. 17 (6) For achieving the goals and accountability, and 18 fulfilling the requirements and duties required under this Act. 19 c. Notwithstanding section 8.33, moneys appropriated in 20 this subsection that remain unencumbered or unobligated at the 21 close of the fiscal year shall not revert but shall remain 22 available for expenditure for the purposes designated in this 23 subsection until the close of the succeeding fiscal year. 24 2. FINANCIAL ASSISTANCE RESTRICTIONS 25 a. A business creating jobs through moneys appropriated in 26 subsection 1 shall be subject to contract provisions requiring 27 new and retained jobs to be filled by individuals who are 28 citizens of the United States who reside within the United 29 States or any person authorized to work in the United States 30 pursuant to federal law, including legal resident aliens in the 31 United States. 32 b. Any vendor who receives moneys appropriated in 33 subsection 1 shall adhere to such contract provisions and 34 provide periodic assurances as the state shall require that the 35 -4- LSB 1002SV (2) 88 ko/tm 4/ 22
S.F. 608 jobs are filled solely by citizens of the United States who 1 reside within the United States or any person authorized to 2 work in the United States pursuant to federal law, including 3 legal resident aliens in the United States. 4 c. A business that receives financial assistance from 5 the authority from moneys appropriated in subsection 1 shall 6 only employ individuals legally authorized to work in this 7 state. In addition to all other applicable penalties provided 8 by current law, all or a portion of the assistance received 9 by a business which is found to knowingly employ individuals 10 not legally authorized to work in this state is subject to 11 recapture by the authority. 12 3. USES OF APPROPRIATIONS 13 a. From the moneys appropriated in subsection 1, the 14 authority may provide financial assistance in the form of a 15 grant to a community economic development entity for conducting 16 a local workforce recruitment effort designed to recruit former 17 citizens of the state and former students at colleges and 18 universities in the state to meet the needs of local employers. 19 b. From the moneys appropriated in subsection 1, the 20 authority may provide financial assistance to early stage 21 industry companies being established by women entrepreneurs. 22 c. From the moneys appropriated in subsection 1, the 23 authority may provide financial assistance in the form of 24 grants, loans, or forgivable loans for advanced research and 25 commercialization projects involving value-added agriculture, 26 advanced technology, or biotechnology. 27 d. The authority shall not use any moneys appropriated in 28 subsection 1 for purposes of providing financial assistance for 29 the Iowa green streets pilot project or for any other program 30 or project that involves the installation of geothermal systems 31 for melting snow and ice from streets or sidewalks. 32 4. WORLD FOOD PRIZE 33 There is appropriated from the general fund of the state 34 to the economic development authority for the fiscal year 35 -5- LSB 1002SV (2) 88 ko/tm 5/ 22

COUNCILS OF GOVERNMENTS —— ASSISTANCE 25 There is appropriated from the general fund of the state 26 to the economic development authority for the fiscal year 27 beginning July 1, 2019, and ending June 30, 2020, the following 28 amount to be used for the purposes of providing financial 29 assistance to Iowa’s councils of governments: 30 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 225,000 31 7. SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS 6 INTERNSHIPS 7 a. There is appropriated from the Iowa skilled worker and 8 job creation fund created in section 8.75 to the Iowa economic 9 development authority for the fiscal year beginning July 1, 10 2019, and ending June 30, 2020, the following amount, or so 11 much thereof as is necessary, for the purposes designated: 12 For the funding of internships for students studying in the 13 fields of science, technology, engineering, and mathematics 14 with eligible Iowa employers as provided in section 15.411, 15 subsection 3, paragraph “c”: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,000,000 17 b. FUTURE READY IOWA —— VOLUNTEER MENTORING PROGRAM 26 a. There is appropriated from the Iowa skilled worker and 27 job creation fund created in section 8.75 to the economic 28 development authority for the fiscal year beginning July 1, 29 2019, and ending June 30, 2020, the following amount, or so 30 much thereof as is necessary, for the purpose designated: 31 For allocation to the Iowa commission on volunteer services 32 to be used for establishing a volunteer mentor program to 33 support implementation of the future ready Iowa skilled 34 workforce last-dollar scholarship program in section 261.131 35 -7- LSB 1002SV (2) 88 ko/tm 7/ 22

EMPOWER RURAL IOWA —— HOUSING NEEDS ASSESSMENT GRANT 9 PROGRAM 10 a. There is appropriated from the Iowa skilled worker and 11 job creation fund created in section 8.75 to the economic 12 development authority for the fiscal year beginning July 1, 13 2019, and ending June 30, 2020, the following amount, or so 14 much thereof as is necessary, for the purpose designated: 15 To be distributed by the executive committee of the 16 governor’s empower rural Iowa initiative at the recommendation 17 of the investing in rural Iowa task force for establishing 18 a housing needs assessment grant program to provide small 19 communities with hard data and housing-related information 20 specific to the community being analyzed: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 22 b. EMPOWER RURAL IOWA —— RURAL INNOVATION GRANTS 28 a. There is appropriated from the Iowa skilled worker and 29 job creation fund created in section 8.75 to the economic 30 development authority for the fiscal year beginning July 1, 31 2019, and ending June 30, 2020, the following amount, or so 32 much thereof as is necessary, for the purpose designated: 33 To be distributed by the executive committee of the 34 governor’s empower rural Iowa initiative at the recommendation 35 -8- LSB 1002SV (2) 88 ko/tm 8/ 22

Notwithstanding section 8.33, moneys appropriated in 4 this subsection which remain unencumbered or unobligated at 5 the end of the fiscal year shall not revert but shall remain 6 available for expenditure for the purposes designated until the 7 close of the succeeding fiscal year. 8 Sec. 4. LIMITATIONS OF STANDING APPROPRIATIONS —— FY 9 2019-2020. Notwithstanding the standing appropriations 10 in the following designated sections for the fiscal year 11 beginning July 1, 2019, and ending June 30, 2020, the amounts 12 appropriated from the general fund of the state pursuant to 13 these sections for the following purposes shall not exceed the 14 following amounts: 15 1. For operational support grants and community cultural 16 grants under section 99F.11, subsection 3, paragraph “d”, 17 subparagraph (1): 18 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 448,403 19 2. FINANCIAL ASSISTANCE REPORTING —— ECONOMIC 23 DEVELOPMENT AUTHORITY. The economic development authority and 24 the department of revenue shall submit a joint annual report 25 to the general assembly no later than November 1, 2019, that 26 details the amount of every direct loan, forgivable loan, 27 tax credit, tax exemption, tax refund, grant, or any other 28 financial assistance awarded to a person during the prior 29 fiscal year by the authority under an economic development 30 program administered by the authority. The report shall 31 identify the county where the project associated with each such 32 award is located. 33 Sec. 6. INSURANCE ECONOMIC DEVELOPMENT. From the 34 moneys collected by the insurance division in excess of the 35 -9- LSB 1002SV (2) 88 ko/tm 9/ 22
S.F. 608 anticipated gross revenues under section 505.7, subsection 1 3 , during the fiscal year beginning July 1, 2019, $100,000 2 shall be transferred to the economic development authority for 3 insurance economic development and international insurance 4 economic development. 5 Sec. 7. IOWA FINANCE AUTHORITY. 6 1. There is appropriated from the general fund of the state 7 to the Iowa finance authority for the fiscal year beginning 8 July 1, 2019, and ending June 30, 2020, the following amount, 9 or so much thereof as is necessary, to be used to provide 10 reimbursement for rent expenses to eligible persons under 11 the home and community-based services rent subsidy program 12 established in section 16.55: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 14 2. Of the moneys appropriated in this section, not more than 15 $35,000 may be used for administrative costs. 16 3. Notwithstanding section 8.33, moneys appropriated in 17 this section that remain unencumbered or unobligated at the 18 close of the fiscal year shall not revert but shall remain 19 available for expenditure for the purposes designated until the 20 close of the succeeding fiscal year. 21 Sec. 8. IOWA FINANCE AUTHORITY AUDIT. The auditor of state 22 is requested to review the audit of the Iowa finance authority 23 performed by the auditor hired by the authority. 24 Sec. 9. PUBLIC EMPLOYMENT RELATIONS BOARD. 25 1. Of the moneys appropriated in this section, the board 1 shall allocate $15,000 for maintaining an internet site that 2 allows searchable access to a database of collective bargaining 3 information. 4 Sec. 10. DEPARTMENT OF WORKFORCE DEVELOPMENT. There 5 is appropriated from the general fund of the state to the 6 department of workforce development for the fiscal year 7 beginning July 1, 2019, and ending June 30, 2020, the following 8 amounts, or so much thereof as is necessary, for the purposes 9 designated: 10 1. DIVISION OF LABOR SERVICES 11 a. FTEs 26.10 26 b. The division of workers’ compensation shall charge a 27 $100 filing fee for workers’ compensation cases. The filing 28 fee shall be paid by the petitioner of a claim. However, the 29 fee can be taxed as a cost and paid by the losing party, except 30 in cases where it would impose an undue hardship or be unjust 31 under the circumstances. The moneys generated by the filing 32 fee allowed under this subsection are appropriated to the 33 department of workforce development to be used for purposes of 34 administering the division of workers’ compensation. 35 -11- LSB 1002SV (2) 88 ko/tm 11/ 22

UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 13 section 96.9, subsection 4 , paragraph “a”, moneys credited to 14 the state by the secretary of the treasury of the United 15 States pursuant to section 903 of the Social Security 16 Act are appropriated to the department of workforce 17 development and shall be used by the department for the 18 administration of the unemployment compensation program only. 19 This appropriation shall not apply to any fiscal year 20 beginning after December 31, 2019. 21 Sec. 18. The report shall be provided in an 27 electronic format and shall include a list of metrics and 28 criteria mutually agreed to in advance by the board of regents 29 and the economic development authority. The match required of 28 small businesses as defined in section 15.102, subsection 8, 29 for directed contract research or for nondirected research 30 shall be $1 for each $3 of state funds. The match required 31 for other businesses for directed contract research or 32 for nondirected research shall be $1 for each $1 of state 33 funds. Notwithstanding section 8.33, moneys appropriated in 3 subsection 1, paragraphs “a” and “b”, that remain unencumbered 4 or unobligated at the close of the fiscal year shall not revert 5 but shall remain available for expenditure for the purposes 6 designated until the close of the succeeding fiscal year. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill appropriates moneys for the fiscal year 2019-2020 11 from the general fund of the state to the department of 12 cultural affairs, the economic development authority, the Iowa 13 finance authority, the public employment relations board, the 14 department of workforce development, Iowa state university of 15 science and technology, the state university of Iowa, and the 16 university of northern Iowa. 17 The bill appropriates moneys for the fiscal year 2019-2020 18 from the Iowa skilled worker and job creation fund created in 19 Code section 8.75 to the economic development authority, the 20 department of workforce development, the college student aid 21 commission, and the state board of regents and institutions 22 under the control of the board. 23 For the fiscal year 2019-2020, the bill limits standing 24 appropriations established in the Code for the world food 25 prize, certain operational support grants, community cultural 26 grants, and regional tourism marketing. 27 The bill transfers $100,000 of the moneys collected by the 28 insurance division in excess of the anticipated gross revenues 29 under Code section 505.7 to the economic development authority. 30 The bill appropriates moneys for the fiscal year 2019-2020 31 from the special employment security contingency fund to the 32 department of workforce development. 33 The bill appropriates interest earned on the unemployment 34 compensation reserve fund for the fiscal year 2019-2020 to the 35 -21- LSB 1002SV (2) 88 ko/tm 21/ 22
