S.F. 567 Section 1. Section 103.6, subsection 1, Code 2019, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . e. Adopt rules to identify which felonies 3 are violent or sexual in nature. Conviction of such a felony 4 shall be grounds for denial, revocation, or suspension of a 5 license. 6 Sec. 2. Section 103.9, Code 2019, is amended by adding the 7 following new subsection: 8 NEW SUBSECTION . 3. Conviction of a felony that is violent 9 or sexual in nature shall be grounds for denial, revocation, or 10 suspension of a license. Conviction for any other felony shall 11 not be grounds for denial, revocation, or suspension. 12 Sec. 3. Section 103.10, Code 2019, is amended by adding the 13 following new subsection: 14 NEW SUBSECTION . 6. Conviction of a felony that is violent 15 or sexual in nature shall be grounds for denial, revocation, or 16 suspension of a license. Conviction for any other felony shall 17 not be grounds for denial, revocation, or suspension. 18 Sec. 4. Section 103.12, Code 2019, is amended by adding the 19 following new subsection: 20 NEW SUBSECTION . 6. Conviction of a felony that is violent 21 or sexual in nature shall be grounds for denial, revocation, or 22 suspension of a license. Conviction for any other felony shall 23 not be grounds for denial, revocation, or suspension. 24 Sec. 5. Section 103.12A, Code 2019, is amended by adding the 25 following new subsection: 26 NEW SUBSECTION . 4. Conviction of a felony that is violent 27 or sexual in nature shall be grounds for denial, revocation, or 28 suspension of a license. Conviction for any other felony shall 29 not be grounds for denial, revocation, or suspension. 30 Sec. 6. Section 103.13, Code 2019, is amended by adding the 31 following new subsection: 32 NEW SUBSECTION . 4. Conviction of a felony that is violent 33 or sexual in nature shall be grounds for denial, revocation, or 34 suspension of a license. S.F. 567 not be grounds for denial, revocation, or suspension. 1 Sec. 7. Section 103.15, Code 2019, is amended by adding the 2 following new subsection: 3 NEW SUBSECTION . 7. Conviction of a felony that is violent 4 or sexual in nature shall be grounds for denial, revocation, or 5 suspension of a license. Conviction for any other felony shall 6 not be grounds for denial, revocation, or suspension. 7 Sec. 8. Section 103.35, subsection 5, Code 2019, is amended 8 by striking the subsection. 9 Sec. 9. Section 105.10, Code 2019, is amended by adding the 10 following new subsection: 11 NEW SUBSECTION . 5. The board shall adopt rules to identify 12 which felonies are violent or sexual in nature. Conviction 13 of such a felony shall be grounds for denial, revocation, or 14 suspension of a license. 15 Sec. 10. Section 105.18, subsection 1, Code 2019, is amended 16 to read as follows: 17 1. General qualifications. The board shall adopt, by rule, 18 general qualifications for licensure. The board may consider 19 the past felony record of an applicant only if the felony 20 conviction relates to the practice of the profession for which 21 the applicant requests to be licensed. References may be 22 required as part of the licensing process. 23 Sec. 11. Section 105.22, subsection 4, Code 2019, is amended 24 to read as follows: 25 4. Conviction of a felony related to the profession or 26 occupation of the licensee or the conviction of any felony 27 that would affect the licensee’s ability to practice within 28 the profession that is violent or sexual in nature shall be 29 grounds for denial, revocation, or suspension of a license. 30 Conviction of any other felony shall not be grounds for 31 denial, revocation, or suspension . A copy of the record of 32 conviction or plea of guilty shall be conclusive evidence of 33 such conviction. 34 Sec. 12. NEW SECTION . 904.707 Apprenticeship programs —— 35 -2- LSB 1977SV (2) 88 ss/rn 2/ 3
S.F. 567 limitations. 1 An inmate shall not be enrolled in an apprenticeship program 2 if the inmate would be unable to obtain a necessary license to 3 practice the profession to which the apprenticeship relates due 4 to the inmate’s conviction of a felony. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 This bill relates to restrictions on certain professional 9 licenses for persons convicted of felonies. The bill prohibits 10 the electrical examining board and the plumbing and mechanical 11 systems board from denying a professional license to a person 12 on the basis of a felony conviction unless the felony was 13 violent or sexual in nature. 14 The bill also prohibits the department of corrections from 15 enrolling an inmate in an apprenticeship program if the inmate 16 would be unable to obtain a necessary license to practice the 17 profession due to the inmate’s conviction of a felony. 18 -3- LSB 1977SV (2) 88 ss/rn 3/ 3
