1.
MEDICAID
DEMONSTRATION
WAIVER
REQUEST

COMMUNITY
ENGAGEMENT
REQUIREMENTS
FOR
IOWA
HEALTH
AND
WELLNESS

PLAN
MEMBERS.

1.
The
department
of
human
services
shall
submit
a
request
4
by
October
1,
2019,
to
receive
federal
approval
from
the
5
centers
for
Medicare
and
Medicaid
services
of
the
United
States
6
department
of
health
and
human
services
(CMS)
for
a
section
7
1115
demonstration
waiver
to
require
that
as
a
condition
of
8
eligibility,
Iowa
health
and
wellness
plan
members
participate
9
in
community
engagement
activities.
10
2.
The
waiver
request
submitted
by
the
department
shall
11
require
that,
unless
an
individual
is
exempt
pursuant
to
12
subsection
3,
as
a
condition
of
eligibility
for
the
Iowa
health
13
and
wellness
plan,
a
recipient
shall
do
one
of
the
following:
14
a.
Work
twenty
hours
or
more
per
week,
averaged
on
a
monthly
15
basis.
16
b.
Participate
in
and
comply
with
the
requirements
of
a
work
17
program
for
twenty
hours
or
more
per
week,
as
determined
by
the
18
department.
19
c.
Volunteer
twenty
hours
or
more
per
week,
as
determined
20
by
the
department.
21
d.
Meet
a
combination
of
work
and
work
program
participation
22
requirements
for
a
total
of
twenty
hours
or
more
per
week,
as
23
determined
by
the
department.

e.
Participate
in
and
comply
with
the
PROMISE
JOBS
program
25
pursuant
to
chapter
239B.

3.
The
following
individuals
shall
be
exempt
from
the
27
requirements
specified
in
subsection
2:
28
a.
An
individual
medically
certified
as
physically
or
29
mentally
unfit
for
employment.
30
b.
An
individual
who
is
pregnant.
31
c.
A
parent
or
caretaker
responsible
for
the
care
of
a
32
dependent
child
under
one
year
of
age.
33
d.
A
parent
or
caretaker
personally
providing
the
care
for
a
34
dependent
child
with
a
serious
medical
condition
or
disability,

determined
by
the
department.

e.
An
individual
receiving
unemployment
compensation
and
2
complying
with
work
requirements
of
the
federal
or
state
3
unemployment
compensation
system.

f.
An
individual
participating
in
a
drug
or
alcohol
5
treatment
and
rehabilitation
program.

4.
The
department
shall
implement
the
Medicaid
waiver
upon
7
receipt
of
federal
approval
and
shall
adopt
rules
pursuant
to
8
chapter
17A
to
administer
the
waiver
provisions.

EXPLANATION
10
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
department
of
human
services
(DHS)
13
to
submit
a
request
by
October
1,
2019,
to
receive
federal
14
approval
from
the
centers
for
Medicare
and
Medicaid
services
of
15
the
United
States
department
of
health
and
human
services
(CMS)
16
for
a
waiver
to
require
that
as
a
condition
of
eligibility,
17
Iowa
health
and
wellness
plan
members
participate
in
community
18
engagement
activities.
The
bill
specifies
the
types
of
19
community
engagement
activities
to
be
required
under
the
waiver
20
submitted
and
provides
exceptions
to
required
participation
21
in
community
engagement
activities.
The
bill
directs
DHS
to
22
implement
the
waiver
upon
receipt
of
federal
approval
and
to
23
adopt
administrative
rules
to
administer
the
waiver
provisions.
