S.F. 484 Section 1. Section 234.12A, Code 2019, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 2A. A person who possesses three or more 3 electronic benefit transfer cards for which the person is 4 not authorized to possess is guilty of a fraudulent practice 5 pursuant to section 234.13, subsection 4. 6 NEW SUBSECTION . 2B. A law enforcement officer who has 7 probable cause to believe that a person possesses an electronic 8 benefits transfer card that the person is not authorized 9 to possess shall report the name on the electronic benefit 10 transfer card and the name of the person in possession of 11 the electronic benefits transfer card to the department of 12 inspections and appeals. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to electronic benefits transfer (EBT) 17 cards under the food assistance program and makes penalties 18 applicable. 19 The bill provides that a person who possesses three or more 20 EBT cards for which the person is not authorized to possess 21 is guilty of a fraudulent practice pursuant to Code section 22 234.13(4) (fraudulent practices relating to food programs). 23 The bill provides that a law enforcement officer who has 24 probable cause to believe that a person possesses an EBT card 25 that the person is not authorized to possess shall report the 26 name on the EBT card and the name of the person in possession of 27 the card to the department of inspections and appeals. 28 -1- LSB 1876SV (3) 88 hb/rh 1/ 1
