S.F. 422 Section 1. Section 279.50, subsection 9, paragraph c, Code 1 2019, is amended to read as follows: 2 c. “HPV” means human papilloma virus papillomavirus as 3 defined by the centers for disease control and prevention of 4 the United States department of health and human services. 5 Sec. 2. Section 514C.23, Code 2019, is amended to read as 6 follows: 7 514C.23 Human papilloma virus papillomavirus vaccinations —— 8 coverage. 9 1. As used in this section, “human papillomavirus” means 10 the human papillomavirus as defined by the centers for disease 11 control and prevention of the United States department of 12 health and human services. 13 1. 2. Notwithstanding the uniformity of treatment 14 requirements of section 514C.6 , a contract, policy, or plan 15 providing for third-party payment or prepayment of health 16 or medical expenses that provides coverage benefits for any 17 vaccination or immunization shall provide coverage benefits 18 for a vaccination for human papilloma virus, including but not 19 limited papillomavirus vaccinations administered in accordance 20 with the current recommendations issued by the centers for 21 disease control and prevention of the United States department 22 of health and human services. 23 3. This section applies to the following classes of 24 third-party payment provider contracts, policies, or plans 25 delivered, issued for delivery, continued, or renewed in this 26 state on or after January 1, 2009: 27 a. Individual or group accident and sickness insurance 28 providing coverage on an expense-incurred basis. 29 b. An individual or group hospital or medical service 30 contract issued pursuant to chapter 509 , 514 , or 514A . 31 c. An individual or group health maintenance organization 32 contract regulated under chapter 514B . 33 d. An individual or group Medicare supplemental policy, 34 unless coverage pursuant to such policy is preempted by federal 35 -1- LSB 2698XS (4) 88 ko/rn 1/ 3
S.F. 422 law. 1 e. A plan established pursuant to chapter 509A for public 2 employees. 3 2. 4. This section shall not apply to accident-only, 4 specified disease, short-term hospital or medical, hospital 5 confinement indemnity, credit, dental, vision, long-term care, 6 basic hospital and medical-surgical expense coverage as defined 7 by the commissioner, disability income insurance coverage, 8 coverage issued as a supplement to liability insurance, 9 workers’ compensation or similar insurance, or automobile 10 medical payment insurance. 11 3. As used in this section , “human papilloma virus” means 12 the human papilloma virus as defined by the centers for disease 13 control and prevention of the United States department of 14 health and human services. 15 4. 5. The commissioner of insurance shall adopt rules 16 pursuant to chapter 17A as necessary to administer this 17 section . 18 Sec. 3. APPLICABILITY. This Act applies to third-party 19 payment provider policies, contracts, or plans delivered, 20 issued for delivery, continued, or renewed in this state on or 21 after January 1, 2020. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill provides that mandated health care coverage 26 benefits for human papillomavirus (HPV) vaccinations must 27 be provided for HPV vaccinations administered in accordance 28 with the current recommendations issued by the centers for 29 disease control and prevention of the United States department 30 of health and human services. The bill is applicable to 31 third-party payment provider policies, contracts, or plans 32 delivered, issued for delivery, continued, or renewed in this 33 state on or after January 1, 2020. 34 The bill makes a conforming change to the spelling of 35 -2- LSB 2698XS (4) 88 ko/rn 2/ 3
