S.F. 337 Section 1. Section 92.17, Code 2019, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 6. A child from willfully volunteering 3 as defined by 29 C.F.R. §553.101 for a charitable or public 4 purpose. Section 92.8 applies to volunteering by a child 5 pursuant to this subsection. 6 NEW SUBSECTION . 7. A child twelve years of age or older 7 from being employed by a charitable organization or unit of 8 state or local government as a referee for a sport program 9 sponsored by that charitable organization or unit of state or 10 local government or by an organization of referees sponsored 11 by an organization recognized by the United States olympic 12 committee under 36 U.S.C. §220522. Section 92.8 applies to 13 employment of a child pursuant to this subsection. 14 NEW SUBSECTION . 8. A child under age sixteen from serving 15 in the Iowa summer youth corps program in accordance with 16 section 15H.5 or a child over fourteen years of age from 17 serving in any other recognized program of the Iowa national 18 service corps program in accordance with section 15H.9. 19 Section 92.8 applies to service by a child pursuant to this 20 subsection. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill establishes new exceptions to Code chapter 92, the 25 state child labor law. The bill provides that Code chapter 26 92 does not prohibit a child from willfully volunteering as 27 defined by federal regulation for a charitable or public 28 purpose. The bill provides that Code chapter 92 does not 29 prohibit a child 12 years of age or older from being employed 30 by a charitable organization or unit of state or local 31 government as a referee for a sport program sponsored by that 32 charitable organization or unit of state or local government 33 or by an organization of referees sponsored by an organization 34 recognized by the United States olympic committee under federal 35 -1- LSB 1313SV (2) 88 je/rn 1/ 2

The bill also provides that Code chapter 92 does not 1 prohibit a child under age 16 from serving in the Iowa summer 2 youth corps program or a child over 14 years of age from 3 serving in any other recognized program of the Iowa national 4 service corps program. 5 Prohibitions on persons under 18 years of age working in 6 certain specified occupations under current law apply to 7 volunteering, employment, and service under these exemptions. 8 -2- LSB 1313SV (2) 88 je/rn 2/ 2
