S.F. 322 Section 1. Section 15F.102, subsection 3, paragraph c, Code 1 2019, is amended to read as follows: 2 c. The members appointed pursuant to subsection 2 shall 3 be appointed to two-year three-year staggered terms and the 4 terms shall commence and end as provided by section 69.19 . If 5 a vacancy occurs, a successor shall be appointed to serve the 6 unexpired term. A successor shall be appointed in the same 7 manner and subject to the same qualifications as the original 8 appointment to serve the unexpired term. 9 Sec. 2. Section 15F.104, Code 2019, is amended to read as 10 follows: 11 15F.104 Authority duties. 12 The authority, subject to approval by the board , shall adopt 13 administrative rules pursuant to chapter 17A necessary to 14 administer the programs established pursuant to this chapter . 15 The authority shall provide the board with assistance in 16 implementing administrative functions, marketing the programs, 17 providing technical assistance and application assistance 18 to applicants under the programs, negotiating contracts, 19 and providing project follow-up. The authority may conduct 20 negotiations on behalf of the board with applicants regarding 21 terms and conditions applicable to awards under the programs. 22 Sec. 3. Section 15F.204, subsection 5, unnumbered paragraph 23 1, Code 2019, is amended to read as follows: 24 At the beginning of each fiscal year, the board shall 25 allocate one hundred thousand dollars for purposes of marketing 26 those projects that are receiving moneys from the fund. After 27 the marketing allocation, the The board shall allocate all 28 remaining moneys in the fund in the following manner: 29 Sec. 4. Section 15F.401, subsection 9, Code 2019, is amended 30 to read as follows: 31 9. The authority, with the approval of the board , shall 32 adopt rules for the administration of this subchapter . 33 Sec. 5. TRANSITION —— APPOINTMENT AND TERM OF ENHANCE IOWA 34 BOARD MEMBERS. S.F. 322 term of a member serving on the enhance Iowa board immediately 1 prior to the effective date of this Act. For terms beginning 2 May 1, 2019, four members shall be appointed to a three-year 3 term and one member shall be appointed to a two-year term. For 4 terms beginning May 1, 2020, four members shall be appointed 5 to a three-year term and two members shall be appointed to a 6 one-year term. For a term beginning May 1, 2021, or after, all 7 members shall be appointed to a three-year term. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to the enhance Iowa board. 12 The bill increases the term of voting members on the board 13 from two to three years. The bill provides for a transition 14 from the current two-year staggered terms to three-year 15 staggered terms. 16 The bill directs the board, rather than the economic 17 development authority, to adopt rules to administer the 18 programs established in Code chapter 15F. 19 The bill eliminates the requirement that the board, at the 20 beginning of each fiscal year, allocate $100,000 from the 21 community attraction and tourism fund to market projects that 22 are receiving moneys from the fund. 23 -2- LSB 1285SV (1) 88 ko/tm 2/ 2
