Section
1.
Section
321.178,
subsection
1,
paragraph
b,

subparagraph
(2),
subparagraph
division
(a),
Code
2019,
is

amended
to
read
as
follows:

(a)
To
be
qualified
to
provide
street
or
highway
driving
4
instruction,
a
person
shall
be
certified
by
the
department
and
5
authorized
by
the
board
of
educational
examiners.
However,
6
if
the
person
is
a
peace
officer,
as
defined
in
section
7
801.4,
subsection
11,
paragraph
“a”
,
“b”
,
“c”
,
or
“h”
,
with
8
five
or
more
years
of
experience
as
a
peace
officer,
or
a
9
retired
peace
officer
who
holds
a
driver’s
license
that
is
10
valid
for
more
than
two
years
from
the
date
of
issuance,
the
11
person
shall
not
be
required
to
be
authorized
by
the
board
12
of
educational
examiners.
A
person
shall
not
be
required
13
to
hold
a
current
Iowa
teacher
or
administrator
license
at
14
the
elementary
or
secondary
level
or
to
have
satisfied
the
15
educational
requirements
for
an
Iowa
teacher
license
at
the
16
elementary
or
secondary
level
in
order
to
be
certified
by
the
17
department
or
authorized
by
the
board
of
educational
examiners
18
to
provide
street
or
highway
driving
instruction.
For
purposes
19
of
this
subparagraph
division,
“retired
peace
officer”
means
20
a
person
retired
under
chapter
97A
or
411,
or
section
97B.49B

or
97B.49C,
after
service
as
a
peace
officer,
as
defined
in
22
section
801.4,
subsection
11,
paragraph
“a”
,
“b”
,
“c”
,
or
“h”
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
to
be
qualified
to
provide
street
or
27
highway
driving
instruction,
a
person
must
be
certified
28
by
the
department
of
transportation
(DOT)
and
authorized
29
by
the
board
of
educational
examiners.
This
bill
provides
30
that
if
the
person
is
a
peace
officer
with
five
or
more
31
years
of
experience,
or
a
retired
peace
officer
who
holds
a
32
driver’s
license
valid
for
more
than
two
years
from
the
date
33
of
issuance,
the
person
need
not
be
authorized
by
the
board
34
of
educational
examiners.
Under
the
bill,
“peace
officer”

includes
sheriffs
and
their
regular
deputies
who
are
subject
to
1
mandated
law
enforcement
training,
marshals
and
police
officers
2
of
cities,
peace
officer
members
of
the
department
of
public
3
safety,
and
employees
of
the
DOT
designated
as
peace
officers.

The
bill
defines
“retired
peace
officer”
to
mean
a
person
5
retired
under
Code
chapter
97A
or
411,
or
Code
section
97B.49B
6
or
97B.49C,
after
service
as
a
peace
officer.
