S.F. 2316 Section 1. Section 321.34, subsection 16, paragraph a, Code 1 2020, is amended to read as follows: 2 a. An owner referred to in subsection 12 who is a member 3 of the national guard, as defined in chapter 29A , may, 4 upon written application to the department, order special 5 registration plates with a national guard processed emblem 6 with the emblem designed by the department in cooperation 7 with the adjutant general which emblem signifies that the 8 applicant is a member of the national guard. The application 9 shall be approved by the department in consultation with the 10 adjutant general. The special plate fees collected by the 11 director under subsection 12 , paragraph “a” , from the annual 12 validation of letter-number designated national guard plates, 13 and subsection 12 , paragraph “c” , from the issuance and annual 14 validation of personalized national guard plates shall be paid 15 monthly to the treasurer of state and deposited in the road 16 use tax fund. The treasurer of state shall transfer monthly 17 from the statutory allocations fund created under section 18 321.145, subsection 2 , to the veterans license fee trust fund 19 created in section 35A.11 35A.13 the amount of the special fees 20 collected under subsection 12 , paragraph “a” , in the previous 21 month for national guard plates. Special registration plates 22 with a national guard processed emblem shall be surrendered, as 23 provided in subsection 12 , in exchange for regular registration 24 plates upon termination of the owner’s membership in the active 25 national guard. 26 Sec. 2. Section 321.34, subsection 17, paragraph a, Code 27 2020, is amended to read as follows: 28 a. An owner referred to in subsection 12 who was at Pearl 29 Harbor, Hawaii, as a member of the armed services of the United 30 States on December 7, 1941, may, upon written application 31 to the department, order special registration plates with a 32 Pearl Harbor processed emblem. The emblem shall be designed 33 by the department in consultation with service organizations. 34 The application is subject to approval by the department. 35 -1- LSB 5479SV (2) 88 ec/rn 1/ 8
S.F. 2316 The special plate fees collected by the director under 1 subsection 12 , paragraph “a” , from the annual validation of 2 letter-number designated Pearl Harbor plates, and subsection 3 12 , paragraph “c” , from the issuance and annual validation of 4 personalized Pearl Harbor plates shall be paid monthly to the 5 treasurer of state and deposited in the road use tax fund. The 6 treasurer of state shall transfer monthly from the statutory 7 allocations fund created under section 321.145, subsection 8 2 , to the veterans license fee trust fund created in section 9 35A.11 35A.13 the amount of the special fees collected under 10 subsection 12 , paragraph “a” , in the previous month for Pearl 11 Harbor plates. 12 Sec. 3. Section 321.34, subsection 18, paragraph a, Code 13 2020, is amended to read as follows: 14 a. An owner referred to in subsection 12 who was awarded 15 a purple heart medal by the United States government for 16 wounds received in military or naval combat against an armed 17 enemy of the United States may, upon written application to 18 the department and presentation of satisfactory proof of the 19 award of the purple heart medal, order special registration 20 plates with a purple heart processed emblem. The design of 21 the emblem shall include a representation of a purple heart 22 medal and ribbon. The application is subject to approval by 23 the department in consultation with the adjutant general. 24 The special plate fees collected by the director under 25 subsection 12 , paragraph “a” , from the annual validation of 26 letter-number designated purple heart plates, and subsection 27 12 , paragraph “c” , from the issuance and annual validation of 28 personalized purple heart plates shall be paid monthly to the 29 treasurer of state and deposited in the road use tax fund. The 30 treasurer of state shall transfer monthly from the statutory 31 allocations fund created under section 321.145, subsection 32 2 , to the veterans license fee trust fund created in section 33 35A.11 35A.13 the amount of the special fees collected under 34 subsection 12 , paragraph “a” , in the previous month for purple 35 -2- LSB 5479SV (2) 88 ec/rn 2/ 8
S.F. 2316 heart plates. 1 Sec. 4. Section 321.34, subsection 19, paragraph a, Code 2 2020, is amended to read as follows: 3 a. An owner referred to in subsection 12 who is a retired 4 member of the United States armed forces may, upon written 5 application to the department and upon presentation of 6 satisfactory proof of membership, order special registration 7 plates with a United States armed forces retired processed 8 emblem. The emblem shall be designed by the department in 9 consultation with service organizations. The application is 10 subject to approval by the department. For purposes of this 11 subsection , a person is considered to be retired if the person 12 is recognized by the United States armed forces as retired 13 from the United States armed forces. The special plate fees 14 collected by the director under subsection 12 , paragraph “a” , 15 from the annual validation of letter-number designated armed 16 forces retired plates, and subsection 12 , paragraph “c” , from 17 the issuance and annual validation of personalized armed forces 18 retired plates shall be paid monthly to the treasurer of state 19 and deposited in the road use tax fund. The treasurer of state 20 shall transfer monthly from the statutory allocations fund 21 created under section 321.145, subsection 2 , to the veterans 22 license fee trust fund created in section 35A.11 35A.13 the 23 amount of the special fees collected under subsection 12 , 24 paragraph “a” , in the previous month for armed forces retired 25 plates. 26 Sec. 5. Section 321.34, subsection 20, paragraph a, Code 27 2020, is amended to read as follows: 28 a. An owner referred to in subsection 12 who was awarded a 29 silver or a bronze star by the United States government, may, 30 upon written application to the department and presentation 31 of satisfactory proof of the award of the silver or bronze 32 star, order special registration plates with a silver or bronze 33 star processed emblem. S.F. 2316 special plate fees collected by the director under subsection 1 12 , paragraph “a” , from the annual validation of letter-number 2 designated silver star and bronze star plates, and subsection 3 12 , paragraph “c” , from the issuance and annual validation of 4 personalized silver star and bronze star plates shall be paid 5 monthly to the treasurer of state and deposited in the road use 6 tax fund. The treasurer of state shall transfer monthly from 7 the statutory allocations fund created under section 321.145, 8 subsection 2 , to the veterans license fee trust fund created in 9 section 35A.11 35A.13 the amount of the special fees collected 10 under subsection 12 , paragraph “a” , in the previous month for 11 silver star and bronze star plates. 12 Sec. 6. Section 321.34, subsection 20A, paragraph a, Code 13 2020, is amended to read as follows: 14 a. An owner referred to in subsection 12 who was awarded 15 a distinguished service cross, a navy cross, or an air force 16 cross by the United States government may, upon written 17 application to the department and presentation of satisfactory 18 proof of the award, order special registration plates with 19 a distinguished service cross, navy cross, or air force 20 cross processed emblem. The emblem shall be designed by the 21 department in consultation with the adjutant general. The 22 special plate fees collected by the director under subsection 23 12 , paragraph “a” , from the annual validation of letter-number 24 designated distinguished service cross, navy cross, and air 25 force cross plates, and subsection 12 , paragraph “c” , from the 26 issuance and annual validation of personalized distinguished 27 service cross, navy cross, and air force cross plates shall 28 be paid monthly to the treasurer of state and deposited in 29 the road use tax fund. The treasurer of state shall transfer 30 monthly from the statutory allocations fund created under 31 section 321.145, subsection 2 , to the veterans license fee 32 trust fund created in section 35A.11 35A.13 the amount of the 33 special fees collected under subsection 12 , paragraph “a” , in 34 the previous month for distinguished service cross, navy cross, 35 -4- LSB 5479SV (2) 88 ec/rn 4/ 8
S.F. 2316 and air force cross plates. 1 Sec. 7. Section 321.34, subsection 20B, paragraph a, Code 2 2020, is amended to read as follows: 3 a. An owner referred to in subsection 12 who was awarded a 4 soldier’s medal, a navy and marine corps medal, or an airman’s 5 medal by the United States government may, upon written 6 application to the department and presentation of satisfactory 7 proof of the award, order special registration plates with 8 a soldier’s medal, navy and marine corps medal, or airman’s 9 medal processed emblem. The emblem shall be designed by the 10 department in consultation with the adjutant general. The 11 special plate fees collected by the director under subsection 12 12 , paragraph “a” , from the annual validation of letter-number 13 designated soldier’s medal, navy and marine corps medal, and 14 airman’s medal plates, and subsection 12 , paragraph “c” , from 15 the issuance and annual validation of personalized soldier’s 16 medal, navy and marine corps medal, and airman’s medal plates 17 shall be paid monthly to the treasurer of state and deposited 18 in the road use tax fund. The treasurer of state shall 19 transfer monthly from the statutory allocations fund created 20 under section 321.145, subsection 2 , to the veterans license 21 fee trust fund created in section 35A.11 35A.13 the amount of 22 the special fees collected under subsection 12 , paragraph “a” , 23 in the previous month for soldier’s medal, navy and marine 24 corps medal, and airman’s medal plates. 25 Sec. 8. Section 321.34, subsection 20C, paragraph b, Code 26 2020, is amended to read as follows: 27 b. An owner referred to in subsection 12 who was awarded a 28 combat infantryman badge, combat action badge, combat action 29 ribbon, air force combat action medal, or combat medical 30 badge by the United States government may, upon written 31 application to the department and presentation of satisfactory 32 proof of the award, order special registration plates with a 33 combat infantryman badge, combat action badge, combat action 34 ribbon, air force combat action medal, or combat medical badge 35 -5- LSB 5479SV (2) 88 ec/rn 5/ 8

The special plate fees collected by the 1 director under subsection 12 , paragraph “a” , from the annual 2 validation of letter-number designated combat infantryman 3 badge, combat action badge, combat action ribbon, air force 4 combat action medal, and combat medical badge plates, and 5 subsection 12 , paragraph “c” , from the issuance and annual 6 validation of personalized combat infantryman badge, combat 7 action badge, combat action ribbon, air force combat action 8 medal, and combat medical badge plates shall be paid monthly 9 to the treasurer of state and deposited in the road use tax 10 fund. The treasurer of state shall transfer monthly from the 11 statutory allocations fund created under section 321.145, 12 subsection 2 , to the veterans license fee trust fund created in 13 section 35A.11 35A.13 the amount of the special fees collected 14 under subsection 12 , paragraph “a” , in the previous month for 15 combat infantryman badge, combat action badge, combat action 16 ribbon, air force combat action medal, and combat medical badge 17 plates. 18 Sec. 9. Section 321.34, subsection 24, paragraph a, Code 19 2020, is amended to read as follows: 20 a. An owner referred to in subsection 12 who is the 21 surviving spouse, parent, child, or sibling of a deceased 22 member of the United States armed forces who died while serving 23 on active duty during a time of military conflict or who died 24 as a result of such service may order special registration 25 plates bearing a gold star emblem upon written application 26 to the department accompanied by satisfactory supporting 27 documentation as determined by the department. The gold star 28 emblem shall be designed by the department in cooperation with 29 the commission of veterans affairs. The special plate fees 30 collected by the director under subsection 12 , paragraph “a” , 31 from the annual validation of letter-number designated gold 32 star plates, and subsection 12 , paragraph “c” , from the issuance 33 and annual validation of personalized gold star plates shall 34 be paid monthly to the treasurer of state and deposited in 35 -6- LSB 5479SV (2) 88 ec/rn 6/ 8

The treasurer of state shall transfer 1 monthly from the statutory allocations fund created under 2 section 321.145, subsection 2 , to the veterans license fee 3 trust fund created in section 35A.11 35A.13 the amount of the 4 special fees collected under subsection 12 , paragraph “a” , in 5 the previous month for gold star plates. 6 Sec. 10. Section 321.34, subsection 27, paragraph a, Code 7 2020, is amended to read as follows: 8 a. An owner referred to in subsection 12 who served in the 9 armed forces of the United States and was discharged under 10 honorable conditions may, upon written application to the 11 department and upon presentation of satisfactory proof of 12 military service and discharge under honorable conditions, 13 order special registration plates bearing a distinguishing 14 processed emblem depicting the word “veteran” below an image 15 of the American flag. The application is subject to approval 16 by the department. The special plate fees collected by the 17 director under subsection 12 , paragraph “a” , from the annual 18 validation of letter-number designated United States veteran 19 plates, and subsection 12 , paragraph “c” , from the issuance and 20 annual validation of personalized United States veteran plates, 21 shall be paid monthly to the treasurer of state and deposited 22 in the road use tax fund. The treasurer of state shall 23 transfer monthly from the statutory allocations fund created 24 under section 321.145, subsection 2 , to the veterans license 25 fee trust fund created in section 35A.11 35A.13 the amount of 26 the special fees collected under subsection 12 , paragraph “a” , 27 in the previous month for United States veteran plates. 28 Sec. 11. REPEAL. Section 35A.11, Code 2020, is repealed. 29 Sec. 12. VETERANS LICENSE FEE FUND —— DEPOSIT. Moneys that 30 remain unobligated or unexpended as of June 30, 2020, in the 31 veterans license fee fund created in section 35A.11 shall be 32 deposited in the veterans trust fund created in section 35A.13. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -7- LSB 5479SV (2) 88 ec/rn 7/ 8
S.F. 2316 the explanation’s substance by the members of the general assembly. 1 This bill provides for the deposit of certain fees relating 2 to special military-related motor vehicle registration plates 3 to the veterans trust fund instead of the veterans license fee 4 fund. 5 Code section 321.34, concerning special plates, is amended 6 to provide that an amount equal to the special fees collected 7 for the national guard special plates; Pearl Harbor special 8 plates; purple heart special plates; United States armed 9 forces retired special plates; silver or bronze star plates; 10 distinguished service, navy, or air force cross plates; 11 soldier’s, navy and marine corps, or airman’s medal plates; and 12 combat infantryman badge, combat action badge, combat action 13 ribbon, air force combat action medal, and combat medical badge 14 plates shall be transferred to the veterans trust fund created 15 in Code section 35A.13 instead of the veterans license fee fund 16 created in Code section 35A.11. 17 The bill repeals the veterans license fee fund and provides 18 that any moneys that remain unobligated or unexpended as of 19 June 30, 2020, in the veterans license fee fund shall be 20 deposited in the veterans trust fund. 21 -8- LSB 5479SV (2) 88 ec/rn 8/ 8
