Section
1.
Section
309.57,
subsection
1,
Code
2020,
is
1
amended
to
read
as
follows:
2
1.
The
county
board
of
supervisors,
after
consultation
with
3
the
county
engineer,
and
for
purposes
of
specifying
levels
of
4
maintenance
effort
and
access,
may
classify
the
area
service
5
system
into
three
classifications
termed
area
service
“A”,
6
area
service
“B”,
and
area
service
“C”.
The
area
service
7
“A”
classification
roads
shall
be
maintained
in
conformance
8
with
applicable
statutes.
Area
service
“B”
classification
9
roads
may
have
a
lesser
level
of
maintenance
as
specified
by
10
the
county
board
of
supervisors,
after
consultation
with
the
11
county
engineer.
Area
service
“C”
classification
roads
may
12
have
restricted
access
and
a
minimal
level
of
maintenance
as
13
specified
by
the
county
board
of
supervisors
after
consultation
14
with
the
county
engineer.
An
area
service
“C”
classification
15
shall
apply
to
the
entire
portion
of
a
road
between
the
road’s
16
access
points.
The
county
board
of
supervisors
shall
not
17
classify
only
part
of
a
road
between
the
road’s
access
points,
18
or
only
a
bridge
on
the
road,
as
area
service
“C”.

Sec.
2.
APPLICABILITY.
All
area
service
“C”
20
classifications
in
effect
on
the
effective
date
of
this
21
Act
that
are
not
in
compliance
with
this
Act
shall
be
expanded
22
or
reclassified
to
meet
the
requirements
of
this
Act
on
or
23
before
January
1,
2021.

inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
a
county
board
of
supervisors,
after
28
consultation
with
the
county
engineer,
and
for
purposes
29
of
specifying
levels
of
maintenance
effort
and
access,
may
30
classify
an
area
service
system
into
three
classifications
31
termed
area
service
“A”,
area
service
“B”,
and
area
service
32
“C”.
Area
service
“C”
classification
roads
may
have
restricted
33
access,
but
must
allow
access
to
adjoining
landowners,
and
34
may
have
a
minimal
level
of
maintenance
as
specified
by
the

A
road
with
an
area
service
“C”
classification
2
retains
the
classification
until
such
time
as
a
petition

for
reclassification
is
submitted
to
the
county
board
of

supervisors.
The
petition
must
be
signed
by
one
or
more
5
adjoining
landowners.

This
bill
provides
that
an
area
service
“C”
classification
7
must
apply
to
the
entire
portion
of
a
road
between
the
8
road’s
access
points.
The
bill
prohibits
a
county
board
of
9
supervisors
from
classifying
as
area
service
“C”
only
part
of
a
10
road
between
the
road’s
access
points,
or
only
a
bridge
on
the
11
road.
12
The
bill
provides
that
all
area
service
“C”
classifications
13
currently
in
effect
that
are
not
compliant
with
the
bill
must
14
be
expanded
or
reclassified
to
meet
the
requirements
of
the
15
bill
on
or
before
January
1,
2021.
