S.F. 224 Section 1. Section 299A.1, subsection 2, paragraph b, 1 subparagraph (6), Code 2019, is amended to read as follows: 2 (6) Provides, upon written request from by September 1, 3 annually, to the superintendent of the school district in which 4 the independent private instruction is provided, or from the 5 director of the department of education, a report identifying 6 the primary instructor, location, name of the authority 7 responsible for the independent private instruction, and the 8 names of the students enrolled. In addition, by September 9 1, annually, the child, and the parent, guardian, or legal 10 custodian who intends to place the child under independent 11 private instruction for the school year, shall meet in person 12 with the superintendent of the school district in which the 13 child resides to provide notice of such intent. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill makes a voluntary reporting requirement relating 18 to independent private instruction mandatory, and establishes a 19 notice requirement for the parent, guardian, or legal custodian 20 of a child who places the child under independent private 21 instruction. 22 Currently, the authority responsible for independent private 23 instruction must submit a report relating to the instructors, 24 instruction, and the children placed, to the superintendent 25 of the school district in which the independent private 26 instruction is provided or to the director of the department of 27 education upon receiving a written request. The bill requires 28 that the report be provided to the superintendent by September 29 1, annually, and eliminates reference to the director. 30 The bill also requires the child, and the parent, guardian, 31 or legal custodian who intends to place the child under 32 independent private instruction for the school year, to meet in 33 person with the superintendent of the school district in which 34 the child resides to provide notice of such intent by September 35 -1- LSB 2019XS (6) 88 kh/jh 1/ 2
