S.F. 2166 Section 1. Section 321G.4, subsections 1, 2, and 4, Code 1 2020, are amended to read as follows: 2 1. The owner of each snowmobile required to be registered 3 shall register it annually triennially with the department 4 through a county recorder. The department shall develop 5 and maintain an electronic system for the registration 6 of snowmobiles pursuant to this chapter . The department 7 shall establish forms and procedures as necessary for the 8 registration of snowmobiles. 9 2. The owner of the snowmobile shall file an application 10 for registration with the department through the county 11 recorder of the county of residence in the manner established 12 by the commission. The application shall be completed by the 13 owner and shall be accompanied by a fee of fifteen forty-five 14 dollars and a writing fee as provided in section 321G.27 . A 15 snowmobile shall not be registered by the county recorder 16 until the county recorder is presented with receipts, bills of 17 sale, or other satisfactory evidence that the sales or use tax 18 has been paid for the purchase of the snowmobile or that the 19 owner is exempt from paying the tax. A snowmobile that has 20 an expired registration certificate from another state may be 21 registered in this state upon proper application, payment of 22 all applicable registration and writing fees, and payment of a 23 penalty of five dollars. 24 4. Notwithstanding subsections 1 and 2 , a snowmobile 25 manufactured prior to 1984 may be registered as an antique 26 snowmobile for a one-time fee of twenty-five dollars, which 27 shall exempt the owner from annual triennial registration and 28 fee requirements for that snowmobile. However, if ownership 29 of an antique snowmobile is transferred, the new owner shall 30 register the snowmobile and pay the one-time fee as required 31 under this subsection . An antique snowmobile may be registered 32 with only a signed bill of sale as evidence of ownership. 33 Sec. 2. Section 321G.6, subsections 1 and 4, Code 2020, are 34 amended to read as follows: 35 -1- LSB 5970XS (5) 88 mo/ns 1/ 4

Every snowmobile registration certificate and 1 registration decal issued expires at midnight December 31 of 2 the renewal year unless sooner terminated or discontinued 3 in accordance with this chapter or rules of the commission. 4 After the first day of September each year, an unregistered 5 snowmobile may be registered and a registration may be renewed 6 in one transaction. The fee is five dollars for the remainder 7 of the current year, in addition to the registration fee of 8 fifteen forty-five dollars for the three subsequent year years 9 beginning January 1, and a writing fee as provided in section 10 321G.27 . 11 4. A county recorder or a license agent designated by the 12 director pursuant to section 483A.11 may issue snowmobile 13 registration renewals electronically pursuant to rules adopted 14 by the commission. The fee for a registration renewal issued 15 using an electronic system is fifteen forty-five dollars plus 16 an administrative fee established by the commission and a 17 writing fee as provided in section 321G.27 . 18 Sec. 3. Section 321I.4, subsections 1 and 2, Code 2020, are 19 amended to read as follows: 20 1. The owner of each all-terrain vehicle required to be 21 registered shall register it annually triennially with the 22 department through a county recorder. The department shall 23 develop and maintain an electronic system for the registration 24 of all-terrain vehicles pursuant to this chapter . The 25 department shall establish forms and procedures as necessary 26 for the registration of all-terrain vehicles. 27 2. The owner of the all-terrain vehicle shall file an 28 application for registration with the department through the 29 county recorder of the county of residence, or in the case 30 of a nonresident owner, in the county of primary use, in the 31 manner established by the commission. The application shall 32 be completed by the owner and shall be accompanied by a fee 33 of fifteen forty-five dollars and a writing fee as provided 34 in section 321I.29 . S.F. 2166 registered by the county recorder until the county recorder is 1 presented with receipts, bills of sale, or other satisfactory 2 evidence that the sales or use tax has been paid for the 3 purchase of the all-terrain vehicle or that the owner is 4 exempt from paying the tax. An all-terrain vehicle that has 5 an expired registration certificate from another state may be 6 registered in this state upon proper application, payment of 7 all applicable registration and writing fees, and payment of a 8 penalty of five dollars. 9 Sec. 4. Section 321I.7, subsections 1 and 5, Code 2020, are 10 amended to read as follows: 11 1. a. Every all-terrain vehicle registration certificate 12 and registration decal issued expires at midnight December 31 13 of the renewal year unless sooner terminated or discontinued 14 in accordance with this chapter or rules of the commission. 15 After the first day of September each year, an unregistered 16 all-terrain vehicle may be registered or a registration may be 17 renewed for the three subsequent year years beginning January 18 1. 19 b. After the first day of September an unregistered 20 all-terrain vehicle may be registered for the remainder of 21 the current registration year and for the three subsequent 22 registration year years in one transaction. The fee shall be 23 five dollars for the remainder of the current year, in addition 24 to the registration fee of fifteen forty-five dollars for the 25 three subsequent year years beginning January 1, and a writing 26 fee as provided in section 321I.29 . 27 5. A county recorder or a license agent designated by the 28 director pursuant to section 483A.11 may issue all-terrain 29 vehicle registration renewals electronically pursuant to rules 30 adopted by the commission. The fee for a registration renewal 31 issued using an electronic system is fifteen forty-five dollars 32 plus an administrative fee established by the commission and a 33 writing fee as provided in section 321I.29 . 34 EXPLANATION 35 -3- LSB 5970XS (5) 88 mo/ns 3/ 4
S.F. 2166 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 Under current law, snowmobiles, all-terrain vehicles, 3 and off-road utility vehicles are required to be registered 4 annually with the department of transportation through a county 5 recorder for a fee of $15. The registration certificates 6 and registration decals issued for snowmobiles, all-terrain 7 vehicles, and off-road utility vehicles expire at midnight on 8 December 31. 9 This bill provides that snowmobiles, all-terrain vehicles, 10 and off-road utility vehicles are required to be registered 11 triennially. The registration certificates and registration 12 decals issued to snowmobiles, all-terrain vehicles, and 13 off-road utility vehicles expire at midnight on December 31 14 of the renewal year. Under the bill, the registration fee 15 for snowmobiles, all-terrain vehicles, and off-road utility 16 vehicles is increased to $45. 17 A person who violates the registration requirements for 18 snowmobiles, all-terrain vehicles, and off-road utility 19 vehicles is subject to a $50 scheduled fine.
