S.F. 2090 Section 1. Section 321.385A, Code 2020, is amended to read 1 as follows: 2 321.385A Citation for unlighted headlamp, rear lamp, or rear 3 registration plate light , or bicycle lamp . 4 1. a. A citation issued for failure to have headlamps 5 as required under section 321.385 shall first provide for a 6 seventy-two hour seventy-two-hour period within which the 7 person charged with the violation shall replace or repair the 8 headlamp. 9 b. A citation issued for failure to have rear lamps as 10 required under section 321.387 or a rear registration plate 11 light as required under section 321.388 shall first provide for 12 a seventy-two hour seventy-two-hour period within which the 13 person charged with the violation shall replace or repair the 14 lamps or light. 15 c. A citation issued for failure to have a front or rear 16 lamp on a bicycle as required under section 321.397 shall first 17 provide for a seventy-two-hour period within which the person 18 charged with the violation shall replace or repair the lamp. 19 2. If the person complies with the directive to replace 20 or repair the headlamp, rear lamps, or rear registration 21 plate light , or bicycle lamp within the allotted time period, 22 the citation shall be expunged. If the person fails to 23 comply within the allotted time period, the citation shall be 24 processed in the same manner as other citations. 25 3. A citation issued under this section shall include 26 a written notice of replacement or repair which shall 27 indicate the date of replacement or repair and the manner in 28 which the replacement or repair occurred and which shall be 29 returned to the issuing authority within the seventy-two hour 30 seventy-two-hour time period. 31 Sec. 2. Section 321.397, Code 2020, is amended to read as 32 follows: 33 321.397 Lamps on bicycles. 34 Every At the times specified in section 321.384, every 35 -1- LSB 1547SV (3) 88 mo/ns 1/ 2
S.F. 2090 bicycle shall be equipped with a lamp on the front exhibiting a 1 white light , at the times specified in section 321.384 , visible 2 from a distance of at least three hundred feet to the front and 3 with a lamp on the rear exhibiting a red light visible from a 4 distance of three hundred feet to the rear ; except that a red 5 reflector may be used in lieu of a rear light . A peace officer 6 riding a police bicycle is not required to use either front or 7 rear lamps if duty so requires. 8 Sec. 3. EFFECTIVE DATE. This Act takes effect January 1, 9 2021. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 Current law requires a bicycle to have a front lighted lamp 14 and either a rear lighted lamp or a rear reflector at any time 15 from sunset to sunrise, and at such other times when conditions 16 such as fog, snow, sleet, or rain provide insufficient lighting 17 to render clearly discernible persons and vehicles on the 18 highway at a distance of 500 feet ahead. 19 This bill requires every bicycle to have a front and rear 20 lighted lamp during the stated periods of time, and strikes the 21 provision allowing a bicycle to be equipped a rear reflector 22 in lieu of the rear lighted lamp. The scheduled fine for 23 violating this provision is $25. However, the bill provides 24 that a citation issued for failure to have a front lamp or 25 rear lamp on a bicycle must first provide for a 72-hour period 26 within which the person charged with the violation shall 27 replace or repair the lamp. If the person complies with the 28 directive to replace or repair the lamp, the citation must be 29 expunged. 30 The bill takes effect January 1, 2021. 31 -2- LSB 1547SV (3) 88 mo/ns 2/ 2
