2019,
is

amended
to
read
as
follows:

(a)
To
be
qualified
to
provide
street
or
highway
driving
4
instruction,
a
person
shall
be
certified
by
the
department
and
5
authorized
by
the
board
of
educational
examiners.
However,
if
6
the
person
is
a
peace
officer
or
retired
peace
officer,
the
7
person
shall
not
be
required
to
be
authorized
by
the
board
8
of
educational
examiners.
A
person
shall
not
be
required
9
to
hold
a
current
Iowa
teacher
or
administrator
license
at
10
the
elementary
or
secondary
level
or
to
have
satisfied
the
11
educational
requirements
for
an
Iowa
teacher
license
at
the
12
elementary
or
secondary
level
in
order
to
be
certified
by
the
13
department
or
authorized
by
the
board
of
educational
examiners
14
to
provide
street
or
highway
driving
instruction.
For
purposes
15
of
this
subparagraph
division,
“retired
peace
officer”
means
a
16
person
retired
under
chapter
97A
or
411,
or
section
97B.49B
or
17
97B.49C,
after
service
as
a
peace
officer.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
to
be
qualified
to
provide
street
or
22
highway
driving
instruction,
a
person
must
be
certified
by
23
the
department
of
transportation
(DOT)
and
authorized
by
the
24
board
of
educational
examiners.
This
bill
provides
that
if
the
25
person
is
a
peace
officer
or
retired
peace
officer,
the
person
26
need
not
be
authorized
by
the
board
of
educational
examiners.

Under
Code
section
321.1,
a
peace
officer
is
defined
as
28
every
officer
authorized
to
direct
or
regulate
traffic
or
to
29
make
arrests
for
violations
of
traffic
regulations,
sheriffs
30
and
their
regular
deputies
who
are
subject
to
mandated
law
31
enforcement
training,
marshals
and
police
officers
of
cities,
32
peace
officer
members
of
the
department
of
public
safety,
33
parole
officers,
probation
officers,
special
security
officers

employed
by
board
of
regents
institutions,
conservation

officers,
employees
of
the
DOT
that
are
designated
as
peace
1
officers
by
resolution,
employees
of
an
aviation
authority
2
designated
as
peace
officers
by
the
authority,
and
persons

as
may
be
otherwise
so
designated
by
law.
The
bill
defines
4
retired
peace
officer
to
mean
a
person
retired
under
Code
5
chapter
97A
or
411,
or
Code
section
97B.49B
or
97B.49C,
after
6
service
as
a
peace
officer.
