S.F. 2007 Section 1. Section 902.1, subsection 1, Code 2020, is 1 amended to read as follows: 2 1. Upon a plea of guilty, a verdict of guilty, or a special 3 verdict upon which a judgment of conviction of a class “A” 4 felony may be rendered, the court shall enter a judgment of 5 conviction and shall commit the defendant into the custody of 6 the director of the Iowa department of corrections for the rest 7 of the defendant’s life. Nothing in the Iowa corrections code 8 pertaining to deferred judgment, deferred sentence, suspended 9 sentence, or reconsideration of sentence applies to a class 10 “A” felony, and a person convicted of a class “A” felony shall 11 not be released on parole unless the governor commutes the 12 sentence to a term of years. For the purposes of this section, 13 “life” means a defendant’s natural life, regardless of any 14 life-sustaining procedures, as defined in section 144A.2, that 15 may be used on the defendant during the defendant’s sentence. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill defines a life sentence for purposes of a class 20 “A” felony as the defendant’s natural life, regardless of any 21 life-sustaining procedures that may be used on the defendant 22 during the defendant’s sentence. 23 -1- LSB 5250XS (2) 88 hf/rh 1/ 1
