S.F. 191 Section 1. DIRECTIVE TO DEPARTMENT OF HUMAN SERVICES —— 1 CHILD CARE ASSISTANCE —— FAMILY INCOME ELIGIBILITY REQUIREMENT. 2 1. The department of human services shall amend its 3 administrative rules pursuant to chapter 17A to provide income 4 eligibility for state child care assistance, according to 5 family size for children needing basic care, to families whose 6 nonexempt gross monthly income does not exceed one hundred 7 fifty percent of the federal poverty level, effective January 8 1, 2020, and shall provide for an incremental increase in this 9 income eligibility requirement by five percent every six months 10 thereafter through January 1, 2025. 11 2. The rules adopted pursuant to this section shall take 12 effect January 1, 2020. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to income eligibility requirements for 17 eligible families for state child care assistance. 18 The state child care assistance program is administered by 19 the department of human services (DHS). The bill directs DHS 20 to amend its administrative rules to provide income eligibility 21 for state child care assistance, according to family size for 22 children needing basic care, to families whose nonexempt gross 23 monthly income does not exceed 150 percent of the federal 24 poverty level, effective January 1, 2020. The bill also 25 directs DHS to increase this income eligibility requirement by 26 5 percent every six months thereafer, increasing the family 27 income eligibility requirement to not more than 200 percent of 28 the federal poverty level by January 1, 2025. 29 -1- LSB 1581XS (6) 88 hb/rh 1/ 1
