S.F. 161 Section 1. Section 282.18, subsection 7, paragraph b, 1 subparagraphs (1) and (2), Code 2019, are amended to read as 2 follows: 3 (1) (a) The board of directors of the district of residence 4 shall pay to the receiving district an amount equal to the sum 5 of the state cost following: 6 (i) The regular program foundation base per pupil for the 7 previous school budget year plus either minus the amount per 8 pupil of foundation property tax in the district of residence 9 for the previous school budget year. 10 (ii) Either the teacher leadership supplement state 11 district cost per pupil for the previous fiscal school budget 12 year as provided in section 257.9 257.10 or the teacher 13 leadership supplement foundation aid for the previous fiscal 14 school budget year as provided in section 284.13, subsection 15 1 , paragraph “d” , if both the district of residence and the 16 receiving district are receiving such supplements , plus any . 17 (iii) The teacher salary supplement district cost per 18 pupil for the previous school budget year for the district of 19 residence. 20 (iv) The professional development supplement district cost 21 per pupil for the previous school budget year for the district 22 of residence. 23 (v) The early intervention supplement district cost per 24 pupil for the previous school budget year for the district of 25 residence. 26 (vi) The area education agency teacher salary supplement 27 district cost per pupil for the previous school budget year for 28 the district of residence. 29 (vii) The area education agency professional development 30 supplement district cost per pupil for the previous school 31 budget year for the district of residence. 32 (viii) The special education support services foundation 33 base per pupil for the previous school budget year multiplied 34 by the pupil’s special education weighted enrollment for the 35 -1- LSB 2073XS (2) 88 md/jh 1/ 4
S.F. 161 previous school budget year. 1 (ix) Any moneys received for the pupil as a result of the 2 non-English speaking weighting under section 280.4, subsection 3 3 , for the previous school budget year multiplied calculated by 4 multiplying the regular program state cost per pupil for the 5 previous school budget year by the amount of weighting assigned 6 to the pupil . 7 (x) The amount of any per pupil federal funding received by 8 the district of residence for the school budget year in which 9 the pupil is open enrolled. 10 (b) If the pupil participating in open enrollment is also 11 an eligible pupil under section 261E.6 , the receiving district 12 shall pay the tuition reimbursement amount to an eligible 13 postsecondary institution as provided in section 261E.7 . 14 (2) If a pupil participates in cocurricular or 15 extracurricular activities in accordance with subsection 16 12 , the district of residence may deduct up to two hundred 17 dollars per activity, for up to two activities, from the 18 amount calculated in subparagraph (1) , subparagraph division 19 (a) . For a cocurricular activity, one semester shall equal 20 one activity. Extracurricular activities for which such a 21 resident district may charge up to two hundred dollars per 22 activity for up to two activities under this subparagraph 23 include interscholastic athletics, music, drama, and any 24 other activity with a general fund expenditure exceeding 25 five thousand dollars annually. A pupil may participate in 26 additional extracurricular activities at the discretion of 27 the resident district. The school district of residence may 28 charge the pupil a fee for participation in such cocurricular 29 or extracurricular activities equivalent to the fee charged to 30 and paid in the same manner by other resident pupils. 31 Sec. 2. APPLICABILITY. This Act applies to school budget 32 years beginning on or after July 1, 2020. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -2- LSB 2073XS (2) 88 md/jh 2/ 4
S.F. 161 the explanation’s substance by the members of the general assembly. 1 Current Code section 282.18(7) provides that a pupil 2 participating in open enrollment shall be counted, for state 3 school foundation aid purposes, in the pupil’s district of 4 residence. The school district of residence then is required 5 to pay to the receiving district the sum of the state cost per 6 pupil for the previous school year, plus any moneys received 7 for the pupil as the result of non-English speaking weighting, 8 plus either the teacher leadership supplement state cost per 9 pupil for the previous fiscal year or the teacher leadership 10 supplement foundation aid for the previous fiscal year if 11 both the district of residence and the receiving district are 12 receiving such supplements. 13 This bill modifies the amount required to be paid from the 14 district of residence to the receiving district to be an amount 15 equal to the following: (1) the regular program foundation 16 base per pupil for the previous year minus the amount per pupil 17 of foundation property tax in the district of residence for the 18 previous year; (2) either the teacher leadership supplement 19 district cost per pupil for the previous year or the teacher 20 leadership supplement foundation aid for the previous year, if 21 both the district of residence and the receiving district are 22 receiving such supplements; (3) the teacher salary supplement 23 district cost per pupil for the previous year for the district 24 of residence; (4) the professional development supplement 25 district cost per pupil for the previous year for the district 26 of residence; (5) the early intervention supplement district 27 cost per pupil for the previous year for the district of 28 residence; (6) the area education agency teacher salary 29 supplement district cost per pupil for the previous year for 30 the district of residence; (7) the area education agency 31 professional development supplement district cost per pupil 32 for the previous year for the district of residence; (8) 33 the special education support services foundation base per 34 pupil for the previous year multiplied by the pupil’s special 35 -3- LSB 2073XS (2) 88 md/jh 3/ 4
S.F. 161 education weighted enrollment for the previous year; (9) any 1 moneys received for the pupil as a result of the non-English 2 speaking weighting for the previous school year; and (10) 3 the amount of any per pupil federal funding received by the 4 district of residence for the school budget year as the result 5 of the pupil. 6 By operation of law, the changes in the bill also apply 7 to the amount required to be paid by a resident district to 8 a charter school or innovation zone consortium under Code 9 chapter 256F when the pupil enrolls in such a school outside 10 the pupil’s district of residence. 11 The bill applies to school budget years beginning on or after 12 July 1, 2020. 13 -4- LSB 2073XS (2) 88 md/jh 4/ 4
