Section
260C.14,
subsection
1,
Code
2020,
is
1
amended
to
read
as
follows:

1.
Determine
the
curriculum
to
be
offered
in
such
school
or
3
college
subject
to
approval
of
the
director
and
ensure
that
all
4
career
and
technical
education
offerings
are
competency-based,
5
provide
any
minimum
competencies
required
by
the
department
of
6
education,
comply
with
any
applicable
requirements
in
chapter
7

,
and
are
articulated
with
local
school
district
career
8
and
technical
education
programs.
If
an
existing
private
9
educational
institution
or
an
existing
vocational
institution
10
offering
a
career
and
technical
education
program
within
the
11
merged
area
has
facilities
and
curriculum
of
adequate
size
and
12
quality
which
would
duplicate
the
functions
of
the
area
school,
13
the
board
of
directors
shall
discuss
with
the
institution
the
14
possibility
of
entering
into
contracts
to
have
the
existing
15
institution
offer
facilities
and
curriculum
to
students
of
16
the
merged
area.
The
board
of
directors
shall
consider
any
17
proposals
submitted
by
the
private
institution
for
providing
18
such
facilities
and
curriculum.
The
board
of
directors
19
may
enter
into
such
contracts.
In
approving
curriculum,
20
the
director
shall
ascertain
that
all
courses
and
programs
21
submitted
for
approval
are
needed
and
that
the
curriculum
22
being
offered
by
an
area
school
does
not
duplicate
programs
23
provided
by
existing
public
or
private
facilities
in
the
area.

In
determining
whether
duplication
would
actually
exist,
the
25
director
shall
consider
the
needs
of
the
area
and
consider
26
whether
the
proposed
programs
are
competitive
as
to
size,
27
quality,
tuition,
purposes,
and
area
coverage
with
existing
28
public
and
private
educational
or
vocational
institutions
29
within
the
merged
area.
If
the
board
of
directors
of
the
30
merged
area
chooses
not
to
enter
into
contracts
with
private
31
institutions
under
this
subsection
,
the
board
shall
submit
a
32
list
of
reasons
why
contracts
to
avoid
duplication
were
not
33
entered
into
and
an
economic
impact
statement
relating
to
the
34
board’s
decision
not
duplicate
an
existing
program
offered
by

the

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
if
an
existing
private
educational
8
institution
or
an
existing
vocational
institution
offers
a
9
career
and
technical
education
program
within
the
area
in
which
10
a
community
college
is
located,
and
the
private
or
vocational
11
institution
has
facilities
and
curriculum
of
adequate
size
and
12
quality
which
would
duplicate
the
functions
of
the
community
13
college,
the
community
college
shall
not
duplicate
the
program
14
offered
by
a
private
educational
institution
or
vocational
15
institution
unless
it
is
clearly
shown
that
the
program
offered
16
by
the
private
or
vocational
institution
is
not
meeting
the
17
educational
needs
of
the
area.

The
bill
eliminates
language
requiring
that
the
board
of
19
directors
of
the
community
college
discuss
with
the
private
20
or
vocational
institution
the
possibility
of
entering
into
21
contracts
to
offer
facilities
and
curriculum
to
community
22
college
students,
directing
the
board
to
consider
such
a
23
proposal
offered
by
another
institution,
authorizing
the
board
24
to
enter
into
such
contracts,
and
requiring
the
board
to
submit
25
its
reasons
for
not
entering
into
such
a
contract
and
submit
26
an
economic
impact
statement.
Also
eliminated
is
language
27
requiring
the
director
of
the
department
of
education
to
28
ascertain
that
all
courses
and
programs
are
needed
and
that
the
29
curriculum
offered
by
a
community
college
does
not
duplicate
30
programs
provided
by
existing
public
or
private
facilities
in
31
the
area,
and
specifying
what
the
director
must
consider
in
32
making
such
an
assessment.
