H.F. _____ Section 1. Section 75.1, subsection 2, Code 2020, is amended 1 to read as follows: 2 2. a. When a proposition to authorize an issuance of bonds 3 by a political subdivision subject to this chapter that is not 4 a school district has been submitted to the electors under 5 this section and the proposal fails to gain approval by the 6 required percentage of votes, such proposal, or any proposal 7 which incorporates any portion of the defeated proposal, shall 8 not be submitted to the electors for a period of six months 9 from the date of such regular or special election and may only 10 be submitted on a date specified in section 39.2, subsection 4 , 11 paragraph “a” , “b” , or “c” , as applicable. 12 b. When a proposition to authorize an issuance of bonds by 13 a school district has been submitted to the electors under this 14 section and the proposal fails to gain approval by the required 15 percentage of votes, such proposal, or any proposal which 16 incorporates any portion of the defeated proposal, submitted to 17 the electors on or after the effective date of this Act shall 18 not be submitted to the electors for a period of one year from 19 the date of such regular or special election and may only be 20 submitted on a date specified in section 39.2, subsection 4, 21 paragraph “c” . 22 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 23 immediate importance, takes effect upon enactment. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill makes changes relating to election requirements 28 and limitations for the issuance of certain bonds by school 29 districts. 30 Current law provides that when a bond proposition is 31 submitted to voters and fails to gain approval, the entity 32 submitting the proposal is prohibited from resubmitting the 33 proposal to voters, in any form, for a period of six months. 34 Under the bill, if a school district submits a proposal which 35 -1- LSB 6008YC (2) 88 md/jh 1/ 2
H.F. _____ fails to gain approval of the voters, the school district is 1 then prohibited from resubmitting the proposal or submitting 2 a proposal which incorporates any portion of the defeated 3 proposal to voters for a period of one year. 4 Code section 75.1 applies to school corporations, which 5 by operation of Code section 260C.16, includes merged areas 6 (community colleges).
