H.F. _____ Section 1. Section 483A.8, subsection 3, paragraph c, Code 1 2020, is amended to read as follows: 2 c. (1) The commission shall annually limit to six thousand 3 the number of nonresidents allowed to have antlered or any 4 sex deer hunting licenses. Of the six thousand nonresident 5 antlered or any sex deer hunting licenses issued, five hundred 6 of the licenses shall be reserved for nonresidents who have 7 made a reservation with a hunting guide company which company 8 is currently registered as a business entity with the secretary 9 of state and has maintained registration since prior to July 10 1, 2019. If fewer than five hundred nonresidents apply for 11 a reserved license by the application deadline set by the 12 commission by rule, any license not issued shall be made 13 available for purchase at the same time and in the same 14 manner as other excess nonresident antlered or any sex deer 15 hunting licenses. Not more than thirty-five percent of the 16 issued reserved licenses shall be bow season licenses. The 17 nonresident shall provide with the license application evidence 18 that the reservation is scheduled during a period in which the 19 license is valid. Of the six thousand remaining nonresident 20 antlered or any sex deer hunting licenses issued, not more 21 than thirty-five percent of the licenses shall be bow season 22 licenses. 23 (2) Of the six thousand nonresident antlered or any sex deer 24 hunting licenses issued pursuant to subparagraph (1), three 25 thousand shall be allocated for issuance as part of the license 26 made available in section 483A.24, subsection 19. If fewer 27 than three thousand nonresidents apply for a license under 28 section 483A.24, subsection 19 by the application deadline set 29 by the commission by rule, any license not issued shall be 30 made available for purchase at the same time and in the same 31 manner as other excess nonresident antlered or any sex deer 32 hunting licenses. Of the licenses issued pursuant to this 33 subparagraph or issued as excess nonresident antlered or any 34 sex deer hunting licenses, not more than thirty-five percent of 35 -1- LSB 6122YC (4) 88 js/rn 1/ 5
H.F. _____ the licenses shall be bow season licenses. 1 (3) A fee of six hundred fifty dollars shall be paid for 2 an antlered or any sex deer hunting license issued pursuant 3 to this paragraph that is not part of a nonresident hunting 4 license available under section 483A.24, subsection 19. 5 (2) (4) After the six thousand antlered or any sex 6 nonresident deer hunting licenses have been issued, all 7 additional licenses shall be issued for antlerless deer 8 only. The commission shall annually determine the number of 9 nonresident antlerless deer only deer hunting licenses that 10 will be available for issuance. 11 Sec. 2. Section 483A.8, subsection 5, Code 2020, is amended 12 to read as follows: 13 5. a. The commission shall make available one thousand 14 nonresident landowner antlered or any sex deer hunting licenses 15 for use on the nonresident’s land. Such licenses are not 16 subject to the limits established in subsection 3, paragraph 17 “c” . A fee of six hundred fifty dollars shall be paid for a 18 nonresident landowner antlered or any sex deer hunting license. 19 b. A nonresident owning land in this state may apply for 20 a nonresident antlered or any sex deer hunting license , and 21 the provisions of subsection 3 shall apply or a nonresident 22 landowner antlered or any sex deer hunting license . However, 23 if a nonresident owning land in this state is unsuccessful 24 in obtaining one of the nonresident antlered or any sex deer 25 hunting licenses or one of the nonresident landowner antlered 26 or any sex deer hunting licenses , the landowner shall be given 27 preference for one of the antlerless deer only nonresident 28 deer hunting licenses available pursuant to subsection 3 . A 29 nonresident owning land in this state shall pay the fee for 30 a nonresident antlerless only deer hunting license and the 31 license shall be valid to hunt on the nonresident’s land only. 32 If one or more parcels of land have multiple nonresident 33 owners, only one of the nonresident owners is eligible for 34 a nonresident antlerless only deer hunting license. H.F. _____ nonresident jointly owns land in this state with a resident, 1 the nonresident shall not be given preference for a nonresident 2 antlerless only deer hunting license. The department may 3 require proof of land ownership from a nonresident landowner 4 applying for a nonresident antlerless only deer hunting 5 license. Not more than thirty-five percent of the antlered 6 or any sex deer hunting licenses issued under this subsection 7 shall be bow season licenses. 8 Sec. 3. Section 483A.24, Code 2020, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 19. The commission shall make available 11 to a nonresident a license authorizing the nonresident to 12 hunt for and take one antlered deer, one antlerless deer, one 13 turkey in the fall season, and one coyote. Additionally, the 14 license shall authorize the nonresident to hunt for pheasant 15 during the fall pheasant season and small game during all small 16 game seasons established by the commission. The commission 17 shall charge a fee of one thousand five hundred dollars upon 18 issuance of such license, except that a nonresident landowner 19 eligible to purchase a nonresident landowner antlered or any 20 sex deer hunting license pursuant to section 483A.8, subsection 21 5, may purchase that license as part of the license available 22 under this subsection and the total fee shall be one thousand 23 two hundred dollars. A nonresident landowner who purchases 24 a nonresident landowner deer hunting license as part of the 25 license available under this subsection shall hunt for antlered 26 deer only on the nonresident’s land, but may hunt other game 27 as permitted by law. A license issued under this subsection 28 is subject to the limits for antlered deer established in 29 section 483A.8, subsection 3, paragraph “c” , or section 483A.8, 30 subsection 5, and not more than thirty-five percent of the 31 licenses issued under this section shall allow for the hunting 32 of an antlered deer with a bow. 33 EXPLANATION 34 The inclusion of this explanation does not constitute agreement with 35 -3- LSB 6122YC (4) 88 js/rn 3/ 5
H.F. _____ the explanation’s substance by the members of the general assembly. 1 This bill relates to nonresident deer hunting licenses 2 issued by the natural resource commission. Currently, the 3 commission issues up to 6,000 antlered or any sex deer hunting 4 licenses to nonresidents, which are allocated among zones based 5 on deer populations. Not more than 35 percent of the licenses 6 shall be bow season licenses. 7 The bill requires the commission to reserve 500 of the 8 nonresident antlered or any sex deer hunting licenses for 9 nonresidents who have made a reservation with a hunting 10 guide company which company is currently registered as a 11 business entity with the secretary of state and has maintained 12 registration since prior to July 1, 2019. If fewer than 500 13 nonresidents apply for a reserved license by the application 14 deadline set by the commission, the excess reserved licenses 15 shall be available for purchase in the same manner as other 16 excess nonresident antlered or any sex deer hunting licenses. 17 A nonresident shall include with the license application 18 evidence that the reservation is scheduled for a time during 19 which the license is valid. Not more than 35 percent of the 20 issued reserved licenses and not more than 35 percent of the 21 remaining licenses shall be bow season licenses. 22 Additionally, the bill provides that 3,000 of the 23 nonresident antlered or any sex deer hunting licenses shall 24 be allocated for issuance as part of a type of combination 25 license commonly referred to as a “grand slam license”. The 26 combination license is available for purchase to a nonresident 27 for a fee of $1,500 and allows the nonresident to hunt for and 28 take one antlered deer, one antlerless deer, one wild turkey 29 during the fall wild turkey hunting season, and one coyote. 30 Additionally, the license allows the nonresident to hunt for 31 pheasants during the fall pheasant season and for small game 32 during all small game seasons established by the natural 33 resource commission. Not more than 35 percent of such licenses 34 shall authorize an antlered deer to be taken with a bow. 35 -4- LSB 6122YC (4) 88 js/rn 4/ 5
H.F. _____ The bill also allocates 1,000 nonresident landowner antlered 1 or any sex deer hunting licenses to eligible nonresidents who 2 own land in the state. The nonresident landowner antlered or 3 any sex deer hunting licenses are not included in the limits 4 established for nonresident antlered or any sex deer hunting 5 licenses. The nonresident landowner antlered or any sex deer 6 hunting license shall be available for a fee of $650. A 7 nonresident landowner may purchase a nonresident landowner 8 antlered or any sex deer hunting license as part of a grand 9 slam license for a total fee of $1,200, but the nonresident may 10 only hunt for antlered deer on the nonresident’s property when 11 using the grand slam license in such manner. 12 A person who violates a provision of this bill is subject to 13 a scheduled fine of $25. 14 -5- LSB 6122YC (4) 88 js/rn 5/ 5
