S.F. _____ H.F. _____ Section 1. Section 97B.20A, Code 2020, is amended to read 1 as follows: 2 97B.20A Appeal procedure. 3 Members Employers, members, and third-party payees may 4 appeal any decision made by the system that affects their 5 rights under this chapter . The appeal shall be filed with 6 the system within thirty days after the notification of the 7 decision was mailed to the party’s last known mailing address, 8 or the decision of the system is final. If the party appeals 9 the decision of the system, the system shall conduct an 10 internal review of the decision and the chief executive officer 11 shall notify the individual party who has filed the appeal 12 in writing of the system’s decision. The individual party 13 who has filed the appeal may file an appeal of the system’s 14 final decision with the system under chapter 17A by notifying 15 the system of the appeal in writing within thirty days after 16 the notification of its final decision was mailed to the 17 party’s last known mailing address. Once notified, the system 18 shall forward the appeal to the department of inspections and 19 appeals. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill allows an employer the right to file an 24 administrative appeal with the Iowa public employees’ 25 retirement system (IPERS) concerning any decision made by IPERS 26 that affects their rights under Code chapter 97B.
