H.F. _____ Section 1. Section 321.196, subsection 1, Code 2020, is 1 amended to read as follows: 2 1. Except as otherwise provided, if the licensee is between 3 the ages of seventeen years eleven months and seventy-two years 4 on the date of issuance of the license, a driver’s license, 5 other than an instruction permit, chauffeur’s instruction 6 permit, or commercial learner’s permit issued under section 7 321.180 , expires eight years from the licensee’s birthday 8 anniversary occurring in the year of issuance, but not to 9 exceed the licensee’s seventy-fourth seventy-eighth birthday. 10 If the licensee is under the age of seventeen years eleven 11 months or age seventy-two or over , the license is effective for 12 a period of two years from the licensee’s birthday anniversary 13 occurring in the year of issuance. If the licensee is age 14 seventy-two or over, the license is effective for a period of 15 six years from the licensee’s birthday anniversary occurring in 16 the year of issuance. A licensee whose license is restricted 17 due to vision or other physical deficiencies may be required 18 to renew the license every two years. If a licensee is a 19 foreign national who is temporarily present in this state, 20 the license shall be issued only for the length of time the 21 foreign national is authorized to be present as verified by the 22 department, not to exceed two years. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 Current law provides that if a licensee is between the ages 27 of 17 years 11 months and 72 years on the date of issuance 28 of a driver’s license, the license expires eight years from 29 the licensee’s birthday anniversary occurring in the year of 30 issuance, but not to exceed the licensee’s 74th birthday. 31 This bill alters the upper age limit to the licensee’s 78th 32 birthday. Under current law, if a licensee is age 72 or over, 33 the licensee’s driver’s license is effective for a period of 34 two years from the licensee’s birthday anniversary occurring 35 -1- LSB 5967YC (3) 88 mo/ns 1/ 2
