H.F. _____ DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. (1) For deposit in the water quality initiative fund 15 created in section 466B.45 for purposes of supporting the 16 water quality initiative administered by the division of soil 17 conservation and water quality as provided in section 466B.42 , 18 including salaries, support, maintenance, and miscellaneous 19 purposes, notwithstanding section 8.57, subsection 5 , paragraph 20 “c”: 21 FY 2019-2020: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 23 (2) (a) The moneys appropriated in this lettered 24 paragraph shall be used to support demonstration projects in 25 subwatersheds as designated by the department that are part 26 of high-priority watersheds identified by the water resources 27 coordinating council. 28 (b) The moneys appropriated in this lettered paragraph 29 shall be used to support demonstration projects in watersheds 30 generally, including regional watersheds, as designated by the 31 division and high-priority watersheds identified by the water 32 resources coordinating council. 33 (3) In supporting projects in watersheds and subwatersheds 34 as provided in subparagraph (2), subparagraph divisions (a) and 35 -1- LSB 1008HC (6) 88 ec/tm 1/ 20
H.F. _____ (b), all of the following shall apply: 1 (a) The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 (b) The division shall implement demonstration projects 8 as provided in subparagraph division (a) by providing 9 for participation by persons who hold a legal interest in 10 agricultural land used in farming. To every extent practical, 11 the division shall provide for collaborative participation by 12 such persons who hold a legal interest in agricultural land 13 located within the same subwatershed. 14 (c) The division shall implement demonstration projects on 15 a cost-share basis as determined by the division. Except for 16 edge-of-field practices, the state’s share of the amount shall 17 not exceed 50 percent of the estimated cost of establishing the 18 practice as determined by the division or 50 percent of the 19 actual cost of establishing the practice, whichever is less. 20 (d) The demonstration projects shall be used to educate 21 other persons about the feasibility and value of establishing 22 similar water quality practices. The division shall promote 23 field day events for purposes of allowing interested persons to 24 establish water quality practices on their agricultural land. 25 (e) The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record. 32 (4) The moneys appropriated in this lettered paragraph 33 shall be used to support education and outreach in a manner 34 that encourages persons who hold a legal interest in 35 -2- LSB 1008HC (6) 88 ec/tm 2/ 20
H.F. _____ agricultural land used for farming to implement water quality 1 practices, including the establishment of such practices in 2 watersheds generally, and not limited to subwatersheds or 3 high-priority watersheds. 4 (5) The moneys appropriated in this lettered paragraph 5 may be used to contract with persons to coordinate the 6 implementation of efforts provided in this paragraph. 7 (6) The moneys appropriated in this lettered paragraph 8 may be used by the department to support urban soil and water 9 conservation efforts, which may include but are not limited 10 to management practices related to bioretention, landscaping, 11 the use of permeable or pervious pavement, and soil quality 12 restoration. The moneys shall be allocated on a cost-share 13 basis as provided in chapter 161A . 14 (7) Notwithstanding any other provision of law to the 15 contrary, the department may use moneys appropriated in 16 this lettered paragraph to carry out the provisions of this 17 paragraph on a cost-share basis in combination with other 18 moneys available to the department from a state or federal 19 source. 20 (8) Not more than 10 percent of the moneys appropriated in 21 this lettered paragraph may be used for costs of administration 22 and implementation of the water quality initiative administered 23 by the soil conservation division. 24 b. For purposes of section 8.33, unless 4 specifically provided otherwise, unencumbered or unobligated 5 moneys from an appropriation made in this division of this Act 6 shall not revert but shall remain available for expenditure for 7 the purposes designated until the close of the fiscal year that 8 ends three years after the end of the fiscal year for which the 9 appropriation is made. However, if the project or projects for 10 which such appropriation was made are completed in an earlier 11 fiscal year, unencumbered or unobligated moneys shall revert at 12 the close of that same fiscal year. 13 DIVISION III 14 CHANGES TO PRIOR APPROPRIATIONS 15 Sec. 5. 2014 Iowa Acts, chapter 1136, section 2, as amended 16 by 2018 Iowa Acts, chapter 1162, section 8, is amended to read 17 as follows: 18 SEC. 2. REVERSION. 19 1. Except as otherwise provided in subsection 2, for 20 purposes of section 8.33 , unless specifically provided 21 otherwise, unencumbered or unobligated moneys made from an 22 appropriation in this division of this Act shall not revert 23 but shall remain available for expenditure for the purposes 24 designated until the close of the fiscal year that ends 25 three years after the end of the fiscal year for which the 26 appropriation is made. H.F. _____ 1, 2018 2020 , or until the project for which the appropriation 1 was made is completed, whichever is earlier. 2 Sec. 6. 2016 Iowa Acts, chapter 1133, section 2, is amended 3 to read as follows: 4 SEC. 2. EFFECTIVE DATE. This division of this Act, being 17 deemed of immediate importance, takes effect upon enactment. 18 DIVISION IV 19 DEPARTMENT OF ADMINISTRATIVE SERVICES 20 Sec. 9. Section 8A.321, Code 2019, is amended by adding the 21 following new subsection: 22 NEW SUBSECTION . 15. Prepare an annual report listing any 23 state building, as defined in section 8A.318, that is vacant 24 and submit the annual report to the legislative services agency 25 and the department of management on or before January 15 of 26 each year. 27 Sec. 10. Section 8A.330, subsection 3, Code 2019, is amended 28 to read as follows: 29 3. Moneys in the routine maintenance fund are appropriated 30 to the department for purposes of routine maintenance projects 31 for physical properties under the control of the department 32 state buildings and facilities . For purposes of this section , 33 routine maintenance includes regular upkeep of physical 34 properties and recurring, preventive, and ongoing maintenance 35 -14- LSB 1008HC (6) 88 ec/tm 14/ 20
H.F. _____ necessary to delay or prevent the failure of physical 1 properties. 2 DIVISION V 3 MISCELLANEOUS PROVISIONS 4 Sec. 11. Section 602.11101, subsection 1, paragraph e, 5 subparagraph (2), Code 2019, is amended to read as follows: 6 (2) Until July 1, 1986, the county shall remain responsible 7 for the compensation of and operating costs for court 8 employees not presently designated for state financing and 9 for miscellaneous costs of the judicial branch related to 10 furnishings, supplies, and equipment purchased, leased, or 11 maintained for the use of judicial officers, referees, and 12 their staff. Effective July 1, 1986, the state shall assume 13 the responsibility for the compensation of and operating costs 14 for court employees presently designated for state financing 15 and for miscellaneous costs of the judicial branch related to 16 furnishings, supplies, and equipment purchased, leased, or 17 maintained for the use of judicial officers, referees, and 18 their staff. However, the county shall at all times remain 19 responsible for the provision of suitable courtrooms, offices, 20 and other physical facilities pursuant to section 602.1303, 21 subsection 1 , including paint, wall covering, and fixtures in 22 the facilities. In addition, effective July 1, 2020, if a 23 county expends moneys for the renovation or construction of 24 suitable courtrooms, offices, and other physical facilities 25 pursuant to section 602.1303, that requires the purchase of 26 furnishings, supplies, and equipment for the use of judicial 27 officers, referees, and their staff as a result of that 28 renovation or construction, the cost of the purchase shall not 29 be the sole responsibility of the state. 30 Sec. 12. STATE HISTORICAL BUILDING TASK FORCE. 31 1. A state historical building task force is established 32 within the state fair authority. The state fair authority 33 shall provide administrative support for the task force. 34 2. The task force shall consist of the following members: 35 -15- LSB 1008HC (6) 88 ec/tm 15/ 20
H.F. _____ a. One member appointed by the Iowa state fair board. 1 b. One member appointed by the Iowa state fair foundation 2 established in section 173.22. 3 c. One member appointed by the director of the department of 4 administrative services. 5 d. One member who is designated by the general assembly as 6 the facilities manager for facilities under the control of the 7 general assembly. 8 e. One member appointed by the director of the department of 9 cultural affairs. 10 f. One member appointed by the governor. 11 g. Four members of the general assembly serving as ex 12 officio, nonvoting members, with one representative to be 13 appointed by the speaker of the house of representatives, one 14 representative to be appointed by the minority leader of the 15 house of representatives, one senator to be appointed by the 16 majority leader of the senate, and one senator to be appointed 17 by the minority leader of the senate. 18 3. The task force shall consider the feasibility, costs, 19 and possible options relative to construction of a new state 20 historical building museum on the state fairgrounds, to include 21 options for relocating the collections stored in the current 22 state historical building and creating increased access to the 23 collections to Iowans. 24 4. The task force shall provide an interim report to 25 the general assembly by December 20, 2019, concerning the 26 activities of the task force and shall submit its final report, 27 including its findings and recommendations, to the general 28 assembly by January 1, 2021. 29 DIVISION VI 30 VACANT STATE BUILDINGS —— FUNDS 31 Sec. 13. NEW SECTION . 15.261 Vacant state buildings 32 demolition fund. 33 1. A vacant state buildings demolition fund is created in 34 the state treasury under the control of the authority. H.F. _____ fund shall consist of all moneys appropriated to the fund. 1 2. Moneys in the vacant state buildings demolition fund are 2 appropriated to the authority for purposes of funding a grant 3 program for the demolition of vacant buildings owned by the 4 state which are no longer used for a state purpose. 5 3. Notwithstanding section 12C.7, subsection 2, interest 6 or earnings on moneys deposited in the vacant state buildings 7 demolition fund shall be credited to the vacant state buildings 8 demolition fund. Notwithstanding section 8.33, moneys credited 9 to the vacant state buildings demolition fund shall not revert 10 at the close of a fiscal year. 11 Sec. 14. NEW SECTION . 15.262 Vacant state buildings 12 rehabilitation fund. 13 1. A vacant state buildings rehabilitation fund is created 14 in the state treasury under the control of the authority. The 15 fund shall consist of all moneys appropriated to the fund. 16 2. Moneys in the vacant state buildings rehabilitation fund 17 are appropriated to the authority for purposes of funding a 18 loan program for the rehabilitation or redevelopment of vacant 19 buildings owned by the state which are no longer used for a 20 state purpose. 21 3. Notwithstanding section 12C.7, subsection 2, interest 22 or earnings on moneys deposited in the vacant state buildings 23 rehabilitation fund shall be credited to the vacant state 24 buildings rehabilitation fund. Notwithstanding section 8.33, 25 moneys credited to the vacant state buildings rehabilitation 26 fund shall not revert at the close of a fiscal year. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill relates to and makes appropriations to state 31 departments and agencies from the rebuild Iowa infrastructure 32 fund and the technology reinvestment fund, and provides for 33 related matters. The bill is organized by divisions. 34 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 35 -17- LSB 1008HC (6) 88 ec/tm 17/ 20
H.F. _____ division appropriates project funding for FY 2019-2020 from 1 the rebuild Iowa infrastructure fund for projects for the 2 departments of administrative services, agriculture and land 3 stewardship, corrections, cultural affairs, human services, 4 natural resources, public defense, public safety, and 5 transportation, and for the office of the chief information 6 officer, the board of regents, the treasurer of state, 7 Iowa veterans home, and the judicial branch. The division 8 appropriates project funding for FY 2019-2020 and FY 2020-2021 9 from the rebuild Iowa infrastructure fund for projects for the 10 state fair authority and appropriates project funding from the 11 rebuild Iowa infrastructure fund for multiple fiscal years to 12 the economic development authority. 13 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This division 14 appropriates project funding for FY 2019-2020 from the 15 technology reinvestment fund for the departments of education, 16 homeland security and emergency management, human rights, human 17 services, management, public health, public safety and veterans 18 affairs, and for the office of the chief information officer, 19 the Iowa law enforcement academy, and state public defender. 20 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 21 division makes a change to the reversion provision for moneys 22 appropriated to the department of natural resources from the 23 rebuild Iowa infrastructure fund in FY 2014-2015. The division 24 also makes a change to the reversion provision for moneys 25 appropriated from the rebuild Iowa infrastructure fund to 26 the department of administrative services for the costs of 27 major maintenance of monuments in FY 2016-2017. The division 28 makes changes to moneys appropriated to the department of 29 administrative services for major maintenance projects from 30 the rebuild Iowa infrastructure fund in FY 2018-2019 and FY 31 2019-2020 by eliminating the priority to projects for repair of 32 the roof of the state historical building. The division of the 33 bill takes effect upon enactment. 34 DIVISION IV —— DEPARTMENT OF ADMINISTRATIVE SERVICES. 35 -18- LSB 1008HC (6) 88 ec/tm 18/ 20
H.F. _____ Code section 8A.321 is amended to require the director of 1 the department of administrative services to prepare an 2 annual report of vacant state buildings and to submit the 3 report to the legislative services agency and the department 4 of management on or before January 15 of each year. Code 5 section 8A.330, concerning the routine maintenance fund under 6 the control of the department of administrative services, is 7 amended to provide that moneys in the fund may be appropriated 8 for routine maintenance projects for state buildings and 9 facilities and not just physical properties under the control 10 of the department. 11 DIVISION V —— MISCELLANEOUS PROVISIONS. Code section 12 602.11101, concerning responsibility for county courthouses 13 and attendant costs, is amended to provide that, effective 14 July 1, 2020, if a county expends moneys for the renovation 15 or construction of suitable courtrooms, offices, and other 16 physical facilities that requires the purchase of furnishings, 17 supplies, and equipment as a result of that renovation or 18 construction, the state shall not be solely responsible for the 19 cost of the purchase. 20 The bill also establishes a state historical building task 21 force within the state fair authority. The bill provides for 22 membership on the task force and directs the task force to 23 consider the feasibility, costs, and possible options relative 24 to construction of a new state historical building museum on 25 the state fairgrounds, to include options for relocating the 26 collections stored in the current state historical building, 27 and to create increased access to the collections to Iowans. 28 The bill requires the task force to submit an interim report 29 to the general assembly by December 20, 2019, and to submit a 30 final report, including its findings and recommendations, to 31 the general assembly by January 1, 2021. 32 DIVISION VI —— VACANT STATE BUILDINGS —— FUNDS.
