H.F. _____ Section 1. Section 633A.4604, subsection 2, Code 2019, is 1 amended to read as follows: 2 2. The certification of trust must contain a statement do 3 all of the following: 4 a. State that the trust has not been revoked, modified, 5 or amended in any manner which that would cause the 6 representations contained in the certification of trust to be 7 incorrect and must contain a statement that it is being . 8 b. Be signed by all of the a currently acting trustees of 9 the trust and is sworn and trustee or the attorney of an acting 10 trustee. 11 c. Be subscribed and sworn to under penalty of perjury 12 before a notary public as provided in chapter 9B . 13 Sec. 2. APPLICABILITY. This Act applies to certifications 14 of trust signed on and after July 1, 2019. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to the requirements for a certification 19 of trust. Under current law, the certification of trust must 20 contain a statement that it is being signed by all of the 21 currently acting trustees of the trust. Under the bill, the 22 certification of trust must be signed by an acting trustee 23 or the attorney for an acting trustee.
